Minutes of a Special Meeting of Council <br />6/12/00 <br />Page 8 <br />Ed Sullivan said Board of Zoning and Appeals has tried to follow the charter very closely and have <br />had considerable discussions during their meetings and expounded, on what was discussed at their <br />previous meetings. <br />Jim Farmer said. there is no specific provision granting Council the right to issue Special Use <br />Permits. He wants to move to grant Council the exact power of granting Special Use Permits and <br />could really act with authority rather than the situation we have today. <br />Mr. Buekholtz said that he doesn't think the answer lies in an outside consulting firm; he agrees with <br />what Jim Farmer said but doesn't feel a professional consultant is the answer. He thinks the answer <br />lies with the people in the room. <br />Dr. Parker felt the message that he thought they left Panzica Construction at the time was that the <br />issue wasn't necessarily closed but Council didn't want to move forward at this time, but we were <br />still interested in how the use of that area was and fmding out how we would go about changing it if <br />appropriate in a logical fashion, and not in a piece-meal kind of thing. He hopes that Panzica could <br />walk away with the message that Council is not opposed to look at this, long term. <br /> <br />Dennis Robasky from Panzica said not withstanding how anyone votes tonight, he feels there should <br />be a meeting with Council and the owners of the realty on Beta how they.feel, if they are renting for <br />less than they did five years ago, some of them are. He feels that Council should ask the people that <br />own the real estate like Panzica and Caputo Brothers, looking at doing. <br />Council President Marquardt said there was a motion already on the floor to repeal the actions of the <br />Board of Zoning and Appeals for the variances granted. Ayes vote will repeal the variances, a no <br />vote will have the variances stand. <br />Roll Call: AYE5: Mr. Busa, Mr. Ilacqua, Mr. Marquardt, Dr. Parker <br />NAYS: Mr. Buckholtz, Mrs. Mills <br />Motion carried. <br />Mr. Samac advised that according to the charter, two-thirds majority of Council is necessary to <br />overturn. Mrs. Mills said this is correct, not two-thirds majority of Council present. <br />Council President Marquardt said he would take that up with Mr. Diemert because the interpretation <br />he had, was two thirds of Council present. <br />Mrs. Mills advises it doesn't say "present" in the charter. <br />Council President Marquardt asked if there were any other comments and there were none. <br />
