Those people up there, <br />there are older homes up there, they did not want that land disturbed. They wanted to be the <br />owners of that property, which did not make sense. Mr. Nichols said they are paying taxes on it. <br />Mayor Rinker replied that they are getting a great deal. They are paying taxes for property they <br />don't have to maintain. <br />Mr. Cappello stated that the deeds are written to the right of way. There is a strip of 50 feet <br />which was never dedicated. Mayor Rinker added it has not been accepted as a public right of <br />way. <br />Mr. Nichols asked if the street will be dedicated. Mayor Rinker suggested Mr. Nichols talk to <br />his neighbors who have the deeds. Mayor Rinker added that this is an issue that came up years <br />ago. They did not get very far with it. It was a difFerent generation of owners. Fundamentally it <br />was complicated. A lot of people just did not want to deal with that issue. Almost by default, the <br />Village has maintained it. We plow it. We paved it. Mr. Nichols advised that about five years <br />ago, the street was completely falling apart. He called the Service Director and he said the <br />Engineer tells us what street to repair. Mr. Nichols called the Engineer and they said that is the <br />worst street in Mayfield Village. Mr. Nichols called Doug and he said they won't pave it <br />because they don't own it. They eventually paved it. Mr. Nichols is thinking that when it comes <br />down to it, the street will come into his yard. When this happens again, we won't have to go <br />through this. <br />Council President Buckholtz advised Mr. Nichols that as always we appreciate his comments. <br />We will be moving forward with the sidewalk program. <br />Council President Buckholtz asked if there were any other comments from the public. There <br />were none. <br />Second Reading of Ordinance No. 2008-25, entitled "An ordinance authorizing and <br />directing the Mayor to negotiate and enter into a non-drilling, non-trespassing oil and gas <br />lease with Seagull Development Corp. regarding certain property known as Permanent <br />Parcel Nos. 831-13-005 (4.75 acres), 831-22-031 (1.22 acres), 831-22-002 (2.5 acres) and <br />all contiguous Village owned properties including S.O.M. Center Road." Introduced by <br />Mayor Rinker and Council as a Whole. (First Reading - July 21, 2008) (Second Reading - <br />August 18, 2008). <br />Second Reading of Ordinance No. 2008-26, entitled "An ordinance authorizing and <br />directing the Mayor to negotiate and enter into a non-drilling, non-trespassing oil and gas <br />lease with Seagull Development Corp. regarding certain property known as Permanent <br />Parcel Nos. 831-40-001 (10 acres) located on the corner of Bonnieview Road and Beech <br />Hill Road." Introduced by Mayor Rinker and Council as a Whole. (First Reading - July <br />21, 2008) (Second Reading - August 18, 2008). <br />These ordinances will be left on Second Read.
