Regular Council Meeting Minutes <br />12-15-08 <br />Page 8 <br />assumption, whose storm sewer is it? Mr. Metzung said the storm sewer that comes off his <br />property on the front corner of his property. We don't maintain storm sewers on private property. <br />Mr. Nichols said the City Engineer when we tied in our storm sewer designed that area to tie <br />into. Now the storm sewers are on private property. Mr. Metzung said any home that someone <br />would come to us and request help for their storm sewer on their property, we would not be able <br />to help them unless there was some larger easement area where we have storm sewers, obviously <br />we would, but if someone's downspout line that goes out to the main street is blocked or broken <br />or something, we do not maintain those. <br />Council President Buckholtz said typically, for example in Worton Park, the culvert was always <br />the homeowner's responsibility. Mr. Nichols said this isn't the culvert. This is where it ties into <br />the main trunk. <br />Mayor Rinker said one of the things we tried to do because we have had instances over the years <br />where the line between private and public use is sometimes blurred. You are making statements <br />that Mayor Rinker can't refute because he does not know the facts of them. But what he can tell <br />Mr. Nichols is we have with the Infrastructure Committee tried to pool resources between a <br />series of private property owners in the Village when we see there is a problem that is more <br />commonly shared and then we feel it is more appropriate for the Village to have a hand in that <br />because there is a larger good served. Typically though when it's an individual property and a <br />property owner, then we are less likely to do it. We are reluctant to do it for the reasons that Mr. <br />Metzung said. That's pretty standard in most communities. When there are specific individual <br />property issues we typically won't get involved. When there are more commonly shared issues <br />then we will. Mayor Rinker does not know which is which here. Mr. Nichols said, you don't <br />know which is which? Mayor Rinker specified, in your instance. Are you talking about <br />something that's yours or are you contending that it is the Village's responsibility? Why is it the <br />Village's responsibility? Mr. Nichols said the Village has storm sewers. Mayor Rinker <br />explained we have all kinds of common areas and public rights of way, when there is a larger <br />issue involved. But when you are talking about an individual property, that's different. That's <br />true with everyone, with limitations, as Mr. Metzung just described them. Mr. Nichols discussed <br />services of the city such as leaf pick-up or blockage from the street. Mayor Rinker replied that <br />tonight is the first that he heard that leaf pick-up is an issue, at the end of leaf season after all this <br />time, so Mr. Nichols is catching him unaware. Mayor Rinker is not sure why Mr. Nichols has a <br />leaf pick-up problem. Mr. Nichols said he takes his up to the main street. Mayor Rinker <br />explained that what the problem is is that Mr. Nichol's lives on a unique drive. He lives on <br />interlocking drives. When that was constructed, there used to be a riding academy back there. <br />Mr. Nichols said he understands. Mr. Nichols is just talking about the services of the city. <br />Mayor Rinker stated that we don't pick up garbage, for example, back behind somebody's house. <br />We don't go up someone's driveway. You live on a very unique, you don't live on a street, you <br />live on a driveway. You have easement rights over private property. Other people have <br />easement rights over private property. Historically, we were told by some of your neighbors to <br />stay of£ Mr. Nichols said she has moved out. <br />Council President Buckholtz suggested to Mr. Nichols to write down his concerns and submit <br />them to Mrs. Betsa in the Village and we will take a look at the specific instances of what you
