Regular Council Meeting Minutes <br />2-16-09 <br />Page 30 <br />At the risk of talking about gas and oil wells, Mr. Marquardt was caught up in the <br />discussion on the authorization for negotiation. He does not particularly like the wording in <br />here. It is sayirig that we are authorizing the Mayor to negotiate in accordance with the Seagull <br />lease. It ought to be authorizing him to negotiate from our position, not from the Seagull lease <br />position. <br />Ms. Calta agreed. The lease that's attached is a lease that they have provided to the <br />Village. She took it and included the recommendations of the Planning Commission. It is not at <br />a point that she would say that it has included everything that has been discussed since that <br />point, but it does include everything that was included in the Planning Commission's <br />recommendation, that laundry list of items that they had included that came before Council. <br />Council President Buckholtz stated it is really a Seagull/Mayfield Village lease as <br />recommended by Planning and Zoning. <br />Ms. Calta stated it includes the Planning Commission's recommendations. <br />Dr. Parker said he does not know that you need to say that. Does it really need to be <br />attached to the Ordinance? It might be kind of - <br />Mayor Rinker asked, misleads? <br />Dr. Parker said yes, he thinks there is a little bit of - <br />Ms. Calta said if you think it's cleaner to put together just an ordinance that would <br />authorize negotiations attached to nothing, you can certainly do that. <br />Mr. Marquardt said he is just trying to get an understanding. <br />Council President Buckholtz said the big issue is what came out on the floor. Are we <br />authorizing the Mayor to go out and negotiate with whatever company is out there that comes <br />forth to suggest gas? That was picked up in the audience. <br />Dr. Parker said at some point we discussed this. <br />Mayor Rinker said Bass has approached us. <br />Dr. Parker said he has a problem with just restricting it just to them. Maybe them and <br />others. <br />Mayor Rinker said that's where his slip up may have been, only because he is thinking <br />the same thing. He does not feel this has to be exclusive, but we have to recognize the risk is <br />always, and not that he would accuse Mr. Yarbrough of not being subtle.
