Minutes of the Regular Meeting of Council <br />Monday, August 15, 2016 <br />Page 11 <br />Mrs. Mills, seconded by Mr. Marrie, made a motion to enact Ordinance No. 2016-19. <br />Council President Saponaro asked, any discussion? <br />Mr. Diemert stated, this relates to the salary positions that have been recently created by <br />Council. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />First Reading of Ordinance No. 2016-20, entitled, "An Emergency Ordinance Revising <br />the Zoning Map of Mayfield Village so as to rezone 2.084 acres of land located on the <br />west side of S.O.M. Center Road and North of Wilson Mills Road and known as <br />Permanent Parcel Number 831-15-003 from its current classification of U-1 Residential <br />District to Office-Laboratory District; and to submit the same to a vote of the Electors.'' <br />Introduced by Mayor Bodnar and Council as a Whole. <br />Mr. Diemert stated, this has to go through multiple readings. I sent Council an outline in May. I <br />will resend it. There has to be three readings at meetings of Council and one public advertised <br />meeting which I will coordinate with Mary Beth. After the public hearing, at our Third Reading, <br />we will vote whether or not to submit it to the electors. <br />I would like to correct something that was in the Minutes of the Planning Commission meeting. <br />On the night of the meeting, unexpectantly, we had a 3-3 tie of the Planning Commission. I had <br />to go back and do some research to see what that constitutes, whether or not that is a denial or an <br />approval. As it turns out, according to our Charter, it is neither, so under Article III, Section <br />11(B) and Article V, Section 11(B) of the Charter, there has to be an affirmative vote of 4 <br />members to indicate a recommendation for or against. As a result, this would be considered a <br />non-action as far as we are concerned. This has little consequence except that if the Planning <br />Commission were to recommend it against the rezoning, we would need 5 votes of Council to <br />pass this legislation. As it is, for the non-action, we only need 4 votes of Council to pass this <br />legislation. <br />Council President Saponaro asked, and again, the legislation that we would be looking to pass or <br />not would be? <br />Mr. Diemert replied, to put it on the ballot. <br />Council President Saponaro stated, to put it on the ballot only. <br />Mr. Diemert added, there probably will be some recommendations for amendments along the <br />way here if Council were inclined, such as the requirement of the Development Agreement if <br />Council were so inclined, prior to the voter's approving it. <br />
