I was reading the February Minutes for The Grove. I see that they
have the first row of stone chairs planned for installation. My concern has to do with the liability
related to that. It has been noted that children can fall off of the stone chairs onto the pavers when they
are sledding. It's less safe. The conversations you had about increased liability would be of interest to
me. and the impact on the liability insurance and if it is impacting liability, what is the incremental
amount?
Mr. Guidetti replied, traditionally the question is whether there is an open and obvious condition or
hidden condition created. My understanding and the Director of Administration can correct me if I am
wrong, but the way it will be constructed, there's not going to be any stone that is actually raised above
the ground. It's not going to be above ground level. There will be a slight drop-off. That would be extra
protected against by a snow fence being installed. I would also recommended the Village contact the
insurer to see if they have any additional problem with it, but I don't foresee that. No special Certificate
of Liability Insurance will be necessary for it.
