<br />Minutes of the Regular Meeting of Council <br />Tuesday, January 21, 2014 <br />Page 9 <br />Third Reading of Ordinance No. 2013-16, entitled, "An Emergency Ordinance <br />amending Codified Ordinance Section 351.03 relating to prohibited standing or parking <br />places and Section 1501.04 enforcement relating to the issuing of citations for violations <br />in 'fire laws." Introduced by Mayor Rinker and Council as a Whole. (First Reading - <br />November 18, 2013; Second Reading - December 16, 2013) <br />Mrs. Mills, seconded by Mr. Marrie, made a motion to enact Ordinance No. 2013-16. <br />Council President Buckholtz asked if there was any discussion. There was none. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />Second Reading of Ordinance No. 2013-17, entitled, "An Emergency Ordinance <br />amending Codified Ordinance Section 1511.05(g)(2)(C) relating to portable outdoor fire <br />places used at one and two family dwellings." Introduced by Mayor Rinker and Council <br />as a Whole. (First Reading - December 16, 2013) <br /> <br />This Ordinance was left on Second Read. <br />Mr. Christian asked, what is the ordinance? I was . here for the First Reading. No one said <br />anything about it. They just read it off. What is the ordinance? <br />Chief Carcioppolo replied, the Fire Code permits these portable units to be within a certain <br />distance as long as they are UL listed. Ordinance Review Board has approved this. I can make <br />you a copy of the ordinance. <br />Mr. Christian asked, is it saying you can't have them? <br />Chief Carcioppolo replied, the Code doesn't pernut the units to be a chiminea. It has to be <br />within a certain distance of a residential property. If we go to an open burning complaint and <br />you have a chiminea and it's too close to your home, we can have you move that within an <br />appropriate distance away from your home so that it won't potentially light your house on fire. <br />Does that make sense? <br />Mr. Christian replied, yes. <br />Mr. Delguyd stated, the ordinance allows us to comply with the Code. <br />Mr. Christian asked, how far away from the house do you have to be? <br />Chief Carcioppolo replied, if it is UL listed for a certain distance, whatever that UL listing is <br />would allow that to be up to that distance from your home. <br />Council President Buckholtz added, there's probably a chart in the State Code that says, number <br />of btu's.
