Minutes of the Regular Meeting of Council <br />Monday, June 20, 2011 <br />Page 10 <br />First Readiniz of Ordinance No. 2011-28, entitled, "An ordinance revising the zone map <br />of Mayfield Village so as to amend the use classification of 1.28 acres of land located on <br />the south side of Wilson Mills Road east of SOM Center Road and known as Permanent <br />Parcel Numbers 831-39-010 and 831-39-011 from its current classification of U-1 <br />residential district to local business." Introduced by Mayor Rinker and Council as a <br />Whole. <br />Ms. Calta clarified prior to reading the Ordinance. I am going to read this in title only for <br />the First Read, but just to note, in the title, the two Permanent Parcel numbers should be <br />831-39-010 and 831-39-009 and Exhibit A should be the legal description. As Mr. <br />Marquardt noted, this is not the correct Exhibit. It should be a legal description and those <br />should have been submitted with the application which I believe the Building Department <br />has. So we will get both of those things corrected for the second read. <br />This Ordinance will be left on first read. <br />Mr. Saponaro asked Ms. Calta, we talked about in Finance the fact that because it's subject <br />to the Development Agreement and deed restrictions, specifically the right of reversion, as <br />it goes to the electorate, we want to make sure that everyone understands what the right of <br />reversion is, how that works, how the deed restrictions work. It's not an unfettered, let's <br />just change it, they can sell it and anyone can open anything they want there. It is <br />specifically for Deacon's and for that particular use, for a car dealership, so that any time <br />in the future if that would change, that would revert back to the U-1 classification. How do <br />we put in the actual questions to the electorate regarding the right of reversion so that <br />people are fully aware of that? I know you don't want to make it five pages long, but you <br />also want to make sure that we are giving the right information when it comes to that. <br />That's key to everyone's way of thinking. <br />Ms. Calta replied, correct. My understanding is just that and that's what this whole <br />process, this will be the First Read, there will be a Second Read, then there will be a 30- <br />day notice of a public hearing, then there will be the public hearing, then there will be the <br />Third Read and during that whole time period, that's what we are intending to <br />communicate to all of the voters in the Village. Obviously, always have all of the <br />information available. We can put what we have on the website. .I am sure that Mr. Deacon <br />will also be able to provide information to those that request it of him as well. <br />Council. President Buckholtz stated, you can't have this in the voting booth, but at least at <br />these other meetings you are talking about a picture, diagrams, depicting what is being <br />proposed for this site as a good opportunity to keep stressing at that time that this is what's <br />being voted on or being proposed and any changes to that could nullify that. In terms of <br />the property changing hands or if someone wanted to use it for a different use, they <br />couldn't do it. <br />Ms. Calta replied, correct.
