12-17-01 <br />Page 21 <br />Council President Marquardt said okay; you weren't at the meetings. <br />Council President Marquardt asked for a roll call. <br />Mr. Buckholtz said he has a question. Again, not to belabor the issue, but I am trying to understand <br />what the issue is in the sense of--Mr. Schiemann, you are talking about a hardship in terms of what <br />the Charter provides and yet we don't know exactly what kind of development or what you are <br />planning to do. I don't even know if it is fair to ask--are you the owner of these properties? <br />Mr. Schiemann said I own 2 of them at this point and have a contract on the 3`d one; yes. <br />Mr. Buckholtz asked: this is yourself--a developer, corporation? <br />Mr. Schiemann said this is me, myself, in my own individual name; yes. <br />Mr. Buckholtz said you are doing this project? Not that it matters... <br />Mr. Schiemann said Bill, just for background: I own 60+ pieces of rental property. I have a <br />Corporation that manages a 190-unit condominium complex. I own a 12,000 square foot piece of <br />commercial properiy in the Warren area. I have primarily been in the residential business but like <br />Donald Trump, at some point you have to go to the commercial side of things. Maybe I patronize <br />myself by saying that, but at some point you have got to go there. <br />Mr. Buckholtz said understanding the process of the vote, maybe you can help me Mr. Diemert, <br />whether it goes on the referendum--is that a Council decision? I remember once before... <br />Mr. Diemert said yes; Council decides to put it on the ballot. <br />Mr. Schiemann said there is a method whereby I could go down and pull a petition and have it on the <br />referendum myself. I don't want to go there. <br />Mr. Buckholtz said but if it didn't come before Council, it wasn't a Council recommendation--the <br />public still takes it-- <br />Mr. Diemert said Council has to adopt this ordinance by February 20th to get it on the May ballot. <br />Anybody can introduce an ordinance through the initiative petition process as Mr. Schiemann is <br />referring to, but that is not before you here. Nothing can go on the ballot without an ordinance being <br />adopted. <br />Mr. Buckholtz said before the vote is made, I would go on the record as saying that when the <br />situation with the doctors came up, I understand that you end up setting precedence with things like <br />this and we need to have a certain amount of consistency when people come before you--what you <br />do for one, you have to do for another. I agree with Council President Marquardt and Mr. Ilacqua in <br />terms of doing things the proper way and going through procedures. I just feel--I think these axe the <br />issues that we need to talk about in the near future. We need to spend more time talking about it. <br />So, if this is the way, to start talking about, maybe we need to have that opporiunity to put it on.
