This Charter section provides for <br />mandatory referral to the voters of any ordinance or resolution which amends ar repeals <br />the zoning map, zoning ordinances, or use classifrcations in any districts. A majority of <br />the voters must approve such legislation before it becomes effective. This Charter <br />Amendment also goes on to say that any existing ordinances inconsistent are "hereby <br />repealed." This section of the Charter can be argued to be contrary to the granting of <br />special use permits in any use district, and conflicting ordinances should be repealed. <br />However, the granting of a special use permit is not an "ordinance or resolution" <br />amending or repealing any zoning ordinance, map or use described in the Charter, <br />Article III, Section 12. Special use permits do not really change any classification or <br />zoning district, but rather, they merely allow an exception to those disfiricts. When <br />granted, any condition can be attached, and tradifiionally the Village has always <br />attached a mandatory renewal requirement every two years. <br />Hopefully this analysis has provided some clarification of the origins and issues <br />surrounding the granting of special use permits.
