PRD Meeting <br />11-25-02 <br />Page 17 <br />in with a piece of property and request under a Special Use Permit permission to construct a <br />development under this zone classification. <br />Mrs. Cinco asked like.... <br />Mr. Samac said well no, it would actually be a different zone classification; perhaps a piece of <br />property that was zoned residential and did not go before the electorate for rezoning under <br />special uses in Chapter 1149, there is an opportunity to go before Planning and go before <br />Council for a Special Use Permit to allow a Development in accordance with 1149 with atwo- <br />year renewal and that sort of thing. I really have got to talk to Joe on how to incorporate that <br />because when you go to 1149 it talks about "unless specified in the Charter" so I don't know <br />how we handle that-ordinance-wise to put in.... <br />Mr. Riter asked, can you specifically exclude it? <br />Mr. Samac said well, that's what I mean. I'm not sure how to do that. I need to talk to Joe about <br />how to do it proper. <br />Mayor Rinker said as it's sitting right now, the argument is this clearly would be in the nature of <br />a use exception that would be against the Charter. <br />Mr.1Vlarrie said a Special Use Permit, you mean? <br />Mayor Rinker said yes, no, yes; but I know that the discussion has come up especially with these <br />permits....and that would be a real hard thing to do. <br />Mr. Samac said yes, I think it would be next to impossible to do but Ithink--- <br />Mr. Marquardt said it should be consistent with the residential zoning which doesn't allow <br />Special Use Permits. <br />Mayor Rinker asked is that how it is written? <br />Mr. Marquardt said they are not allowed in residential areas. <br />Mayor Rinker asked is that the overall residential--- <br />Mr. Marquardt said all the residential classifications preclude.... <br />Mayor Rinker asked do they do it individually or do they do it in the overall section? <br />Mr. Marquardt said I can't tell you. <br />Mayor Rinker said because if you include it in the section then the operation would be... <br />Mr. Samac said look at 1149; 1149 it.... <br />
