Mayfield Village Zoning Code <br />development plan. Any departure from such plan shall be a violation of this <br />these regulations. <br />(3) Any changes in an approved preliminary development plan or final development <br />plan shall be resubmitted for approval in accordance with Section 1159.10. <br />(j) EQUivalencv Consideration: <br />In reviewing the application, the Planning and Zoning Commission may find that a final <br />development plan is equivalent to the requirements of this Zoning Code even though <br />such development plans are not in strict compliance with the numerical requirements, <br />therein. <br />(1) In making such findings the Planning and Zoning Commission may determine <br />that elements of a final development plan are equivalent to a numerical <br />requirement: <br />i. When the proposed final development plan substantially complies with <br />all specific requirements and with the purposes, intent, and basic <br />objectives of the zoning district; <br />ii When through imaginative and skillful design in the arrangement of <br />buildings, open space, streets, access drives, and other features, as <br />disclosed by the application, the proposal results in a development of <br />' j equivalent or higher quality than that which could be achieved through <br />strict application of such standards and requirements; and <br />iii When the development, as proposed, shall have no adverse impact upon <br />the surrounding properties or upon the health, safety, or general welfare <br />of the community. <br />iv Notification of equivalency considerations by Planning Commission <br />shall be given by notice, sent by regular mail, to all adjacent properly <br />owners within a three hundred (300) foot radius of the considered <br />property. Lack of service on any random property will not nullify <br />any decision of the Planning Commission. <br />(2) When evaluating the application with respect to this Section, the Planning and <br />Zoning Commission shall make any finding of equivalency in writing which <br />explains how and why the proposal has satisfied the above criteria. When making <br />such finding, the Commission may approve the proposed application, including <br />waivers from the numerical standards herein, as if the application were in strict <br />compliance with the standards and requirements in this Zoning Code. <br />(k) Approval bv Village Council: <br />(1) The Village Council shall review the Preliminary and Final Development Plan <br />as approved by The Planning and Zoning Commission. Any modifications <br />required by Council shall be submitted for approval prior to start of construction. <br />? <br />i <br />11
