Regular Council Meeting <br />5-19-03 <br />Page 18 <br />Mr. Samac said as was stated and will be reflected in the minutes through Planning Commission <br />when the conditional use was approved, these particular questions did come up. It was with clear <br />understanding that the OMNI representative stated that yes, a conditional use being approved by <br />Planning Commission and ultimately Village Council, enables them to proceed with their work <br />as far as locking up the franchise and other parties (be it the business, building or a restaurant.) <br />Then the conditions will be placed on and with that permit at such times as the definitive plan is <br />submitted so that we know what kind of conditions to place on that particular site and not that <br />particular project. Like I said, all agreed that that would be part of that next Planning <br />Commission's approval; then it moved onto Council. <br />Council President Buckholtz said I think a good Development Agreement might be good. Any <br />more questions? <br />ROLL CALL: AYES: Mr. Buckholtz, Mrs. Cinco, Mr. Marrie, Mrs. Mills, <br />Dr. Parker but would like a written agreement; and Mr. Riter <br />NAYS: Mr. Marquardt <br />Motion Carried <br />Conditional Use Pernut Granted <br />¦ Preliminary Site Plan Developmemt - Carney Construction - 847 S.O.M. <br />Mr. Riter, seconded by Dr. Parker, made a motion to table the Preliminary Site Plan Development <br />for Carney Construction at 847 S.O.M. <br />Mayor Rinker said everyone needs to be aware, prior to even this week, we have had a number of <br />discussions individually, collectively, with Mr. Carney and a number of the other property owners in <br />the area. Our game plan is to come up with a block plan (if you will) that will run from Wilson <br />Mills to Seneca, along S.O.M., provide the kind of uses there that really everyone is going to like; <br />the residents that live nearby and our community in general (we think it is a great opportunity) with <br />the challenges that everything is piecemeal. Mr. Carney is ready to "rock and roll" as they say and <br />what we are trying to do is if we can, buy a little time. It may be necessary. He has indicated he will <br />get back to us, probably, within a month. So that by the time of the next meeting, this is something <br />that we hope to be able to take off the table and then Council can deal with it as it chooses then. But <br />our goal is to arrive at some understanding with Mr. Carney if we can that will facilitate our then <br />being able to deal with all of these properties. Our goal, really, is to be able to work with all the <br />properties and treat them as if they were one. It's easier said than done. It's going to take some <br />effort and we recognize some people can move quicker than others. Mr. Carney being first up with <br />the proposal has kind of necessitated our trying to see what we can do a little more intently. <br />Council President Buckholtz requested a voice vote for the motion on the floor to table the <br />Preliminary Site Plan Development for Carney Construction at 847 S.O.M.
