BOA Minutes <br />July 6, 2017 <br />Pg #2 <br />PEN PORTION <br />Chairman Prcela called the special meeting of the"Zoning Board of Appeals for Mayfield <br />Village to order. Today we are reconsidering Case #2017-03. Applicant is East Cominons, Ltd. <br />requesting a USE Variance to pernut PP #831-05-0.1 S zoned in the office/labora#ory district to <br />be used as a Memory Care Facility. Mr. Diemert said, Mr. Chairman if I could recommend that the two individuals who voted in <br />favor of the variance that resulted in non-action because the majority wasn't here, if one of <br />those could move for reconsideration for the record, and a second, then you could have a <br />majority vote and that will officially put it on the record. <br />; ; CUNSIDERATION OF CASE #2017-03 <br />Mr. Syracuse, seconded by Mr. DiFranco made a motion to reconsider Case #2017-03. <br />ROLL CALL <br />Ayes: Mr. Prcela, Mr. Syracuse," 1VIr. DiFranco, Mrs. Jeanblanc, Mr. Michalko <br />Nays: None Motion Carried <br />r°- <br />OATN <br />Chairman Prcela stated that anyone wishing to speak must be sworn in, administering the oath <br />to the Board Members, Applicants, Appellants and Mayfield Village Directors and asked <br />anyone wishing to speak to state their name and address for the record. <br />Presentation by Sheldon Berns Sheldon Berns, 3733 Park East Dr, Beachwood OH, Attorney for Applicant introduced himself. <br />Thank you for holding this special meeting to reconsider this application. Some of what we're <br />going to present, those that were here heard befbre, but we have some new things. We hope <br />when we're all done we'11 have a vote by acclamation. <br />The property which is owned by East Commons consists of two parcels, one approximately <br />1.012 acres with frontage on SOM Ctr Rd but does not have access to SOM Ctr Rd because <br />access is precluded by a Judgment Entry and it can't be used for construction. The other parcel, <br />almost 5 acres to the west is where ARTIS is planning to build its Memory Care Facility. <br />Sam Cannata who owns the property is here tonight. He's here to describe his'efforts over 7 <br />years to find someone who would use the property for medical offices. He's been unable to find <br />a single user. <br />Roger Ritley is here tonight, he's a Real Estate Appraiser and Property Economist who will tell <br />you why Mr. Cannata was unable to find a user for his property for medical office. He'll tell <br />you why the present pemnitted uses of the property for office and laboratory research use are <br />not economically viable. He'll also describe to you the market demand for memory care ?
