ORDINANCE NO. 2018-11 <br />INTRODUCED BY: Mayor Bodnar and Council as a Whole <br />AN EMERGENCY OItDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR <br />AND PRESIDENT OF COUNCIL TO ENTER INTO A <br />MEMBER COMMUNITY IlVFRASTRUCTURE <br />GRANT PROGRAM AGREEMENT WITH THE <br />NORTHEAST OHIO REGIONAL SEWER DISTRICT <br />WHEREAS, pursuant to Ohio Revised Code Chapter 6119 and Ohio Revised Code <br />Section 6119.06(F), the Northeast Ohio Regional Sewer District (the "District") established a <br />Member Community Infrastructure Program ("MCIP") to provide water resource project funding <br />opportunities to member communities for sewer infrastructure projects in the District's service <br />area; and <br />WHEREAS, the Village of Mayfield submitted an application for the Thornapple Drive <br />and Robley Lane New Sanitary Sewer Project in response to the Northeast Ohio Regional Sewer <br />District's request for MCIP proposals; and <br />WHEREAS, the District has determined that the MCIP Project will address water quality <br />and quantity issues associated with sewer infrastructure that adversely impacts human health and <br />the environment; and <br />WHEREAS, the District has agreed to pay the Village of Mayfield an amount not to <br />exceed Seven Hundred Fifty Thousand Dollars ($750,000.00) on a reimbursement basis, in <br />accordance with the terms outlined in the Member Community Infrastructure Grant Agreement <br />with the Northeast Ohio Regional Sewer District, attached hereto and fully incorporated herein <br />as Exhibit A (the "Agreement"). <br />WHEREAS, Council deems it necessary and in the best interest to the health, safety and <br />welfare of Village residents to authorize acceptance of the Seven Hundred Fifty Thousand <br />Dollars ($750,000), on a reimbursement basis, in accordance with the terms outlined in the <br />Agreement. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Mayfield, <br />County of Cuyahoga and State of Ohio, that:
