V ORDINANCE NO. 2018-16 INTRODUCED BY: Mayor Bodnar and Council as a Whole AN EMERGENCY ORDINANCE AMENDING CHAPTER 176 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO REGARDING MUNICIPAL INCOME TAX i WHEREAS, through Ordinance No. 2015-23, Mayfield Village enacted new Chapter 176 "Municipal Income Tax"; and WHEREAS, through Ohio H.B. 49, updates have been made to the Municipal Income Tax by the Ohio General Assembly since Ohio H.B. 5 was passed; and WHEREAS, through Ordinance No. 2018-04, Mayfield Village enacted amendments to Chapter 176 "Municipal Income Tax" in order to conform to the updates made by Ohio H.B. 49; and WHEREAS, at the time Ordinance No. 2018-04 was enacted provisions of H.B. 49 were the subject of litigation and therefore not enacted by the Village; and WHEREAS, the litigation regarding H.B. 49 has concluded and upon a detailed review of Ohio H.B. 49, this Ordinance is found and determined by this Council to enact the additional amendments required to be in accord with the provisions and limitations specified in Chapter 718 of the Ohio Revised Code. NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, County of Cuyahoga and State of Ohio, that: SECTION 1. Chapter 176 of the Codified Ordinances of Mayfield Village is hereby amended as attached hereto as Exhibit A and incorporated herein by reference. SECTION 2. The passage of this ordinance does not waive any rights of the Village, including, but not limited to, the Village reserving the right under its home rule powers to challenge Ohio House Bi1149, including amendments to Chapter 718 of the Ohio Revised Code. SECTION 2. All other provisions of the Village's Codified Ordinances not inconsistent herewith shall remain in full force and effect. SECTION 3. The Clerk of Council is authorized and directed to forward a certified copy of this Ordinance to the Codifier of the Village of Mayfield.
