RESOLUTION NO. 2018-06 <br />PAGE 3 <br />application of the special assessments, shall be paid by funds available and appropriated for the <br />Improvement Project from the Village's Sewer Relief Fund or from other available funds. <br />SECTION 9. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; and <br />that all deliberations of this Council and of its committees, resulting in such formal action, took <br />place in meetings open to the public in compliance with all statutory requirements including the <br />requirements of Village Charter Article III, Section 7 and Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 10. This Resolution is hereby declared to be an emergency measure necessary <br />for the immediate preservation of the health, safety and welfare of the residents of Mayfield <br />Village and for the reason that the immediate effectiveness of this Resolution is required to <br />provide for the construction of the Improvement Project which is necessary to provide for a <br />system of centralized sewage collection, disposal and treatment and thereby eliminate <br />environmental hazards and preserve and protect the health of the residents of the Village. It <br />shall, therefore, take effect immediately upon adoption by the affirmative vote of not less than <br />six (6) members elected to Council and approval by the Mayor oroterwise at the earliest time <br />allowed by law. <br />JOS H .
