RESOLUTION NO. 2018-45 <br />Introduced by Mayor Bodnar <br />A RESOLUTION AUTHORIZING ANI) DIRECTING <br />THE MAYOR AND PRESIDENT OF COiJNCIL <br />TO ENTER INTO A DEVELOPIVTENT AGREEMENT <br />WITH 345 MINER ROAD LLC <br />WHEREAS, the Village and 345 Miner Road LLC ("Developer"), desire to enter into an <br />agreement involving the improvements to certain unimproved property; and <br />WHEREAS, Developer proposes to construct a housing development in accordance with <br />Chapter 1159 of the Mayfield Village Codified Ordinances on permanent parcel numbers 831- <br />10-007, 831-10-021, 831-10-005, 831-10-006, 831-10-004 and 831-10-003 (the "Property") <br />hereinafter referred to as (the "Development"); and <br />WHEREAS, the Property is zoned partly Single-Family Residential ("SFR") and <br />Production-Distribution District ("PDD") requiring rezoning from SFR and PDD to a Planned <br />Residential Development District ("PRD"). Such rezoning is, by Village Charter, subject to a <br />referendum vote of the electorate; and <br />WHEREAS, the Village has determined that legitimate public interests will be served in <br />the proposed development by: providing residences meeting the purposes and criteria of Chapter <br />1159; by improving the value and usage of presently underutilized property; by increasing public <br />access to and enjoyment of green spaces while better connecting this residential neighborhood <br />with other Village amenities via linkage with the Village's Bruce G. Rinker Greenway; through <br />controlled development that achieves a balance between housing density and green space <br />consistent with Mayfield Village land use and development policies; and <br />WHEREAS, the Development Agreement attached hereto and incorporated herein as <br />Exhibit "A" is. entered into by the parties to recognize and ensure full compliance with the <br />Village's zoning, protection of the public interests and to fully memorialize the parties' <br />respective rights, agreements and obligations relating to the Development as approved by the <br />various Boards, Commissions and Council, which are all incorporated into the Development <br />Agreement. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, <br />Cuyahoga County, State of Ohio that:
