e. Residents of single-family dwellings with frontage on Highland Road shall be <br />allowed access to the Amenities. This access shall be subject to any future <br />homeowner association by-laws. <br />f. The Development shall provide a minimum of 20 feet between each Unit. For <br />purposes of tlus subsection, Attached Uzuts shall be considered a single unit. <br />g. Developer sha11 work with the Village Engineer to ensure adequate drainage in the <br />Development and so as to not disturb or decrease drainage in the surrounding areas <br />on Highland Road and Beta Drive. <br />h. The Development shall include landscaping and buffers along Highland Road to <br />minimize the visual impact of the Development and to provide a harmonious <br />transition between the Development and other property within the Mayfield <br />Village. <br />i. Developer shall design the entry streets within the Development in a curvilinear <br />pattern and to Village specifications in order to qualify for dedication by the <br />Village. <br />j. The site plans shall be substantially similar to The Plans and any modifications to <br />the Plans shall require approval of the Village pursuant to chapter 1159. <br />6. Termination of Agreement. Upon completion of the Development and acceptance thereof <br />by the Village and all other obligations of Developer hereunder or in the event of <br />termination of this Agreement in connection with paragraph 7 below, the parties agree to <br />execute, in recordable form if requested by either party, a statement confirming termination <br />of this Agreement. It is also explicitly understood and agreed that in the event the re-zoning <br />of the Development Property is not approved by the electorate at the May 2019 general <br />election, this Agreement shall automatically terminate. <br />7. Default. In the event that Developer fails to comply in any material respect with any term, <br />condition and/or deed restriction contained herein, the Village may declare a default and <br />terminate this Agreement. In the event of default, the Village may, at its option, buy back <br />the Village Property for the purchase price, less costs of purchase. A reversion clause will <br />be included in the purchase agreement and deed. <br />8. Entire Agreement. Except for entering into a separate purchase agreement foi the sale of <br />the Village Property, this Agreement and the exhibits attached hereto, incorporating <br />Chapter 1159, set forth the complete understanding and agreement of the parties with <br />respect to the Village Property, the Developer Property and the transaction that is the <br />subject of this Agreement. No oral statements, representations or agreements other than <br />this Agreement shall have any force or effect and the Village and Developer agree that they <br />will not rely on any representations or agreements other than those contained in this <br />Agreement. "
