Minutes of the Regular Meeting of Council <br />Monday, October 15; 2018 <br />Page 3 <br />in with their grandparents. That's sometimes not the greatest of circumstances when <br />grandchildren have to move in with their grandparents. It's nice that you have this idealistic <br />vision of a 55 and oldei⢠cominunity, but what are you after? What are you looking at attaining? <br />There would potentially be families in there; but then you will also have potentially grandparents <br />with young fan7ily members due to unforeseen circumstances. <br />Additionally, subsection ( fl which has a provision far Highland Road residents which I would be <br />iinpacted by, tliis says this access shall be subject to any future homeowner association bylaws. <br />My question is; is that subject to the first year it is iiicepted, 2 years down the road, 5 years down <br />the road? Or should it be "shall not"? There's no termination in there. It could be wiped out as <br />soon as the association is established if they change the bylaws. It's in there, but it's not really <br />anything in my opinion at this point. <br />Additionally, there's no provision for a turning lane. <br />What happens in the event, section (h), in regards to drainage in the surrounding roads on <br />Highland and Beta Drive. The termination of agreement and default is a little short sided in my <br />opinion because what happens if drainage occurs years later after the development's already <br />been built out 100%? Is it really realistic for the Village to go back and reclaim that property <br />when it's already been a split lot; etc? What recourse do residents on Highland Road have if our <br />properties start flooding as a result of this development? <br />Those are my only concerns with the Development Agreement. Otherwise, I think this is leaps <br />and bounds ahead of the first proposal and given these issues, I think once we get these things <br />resolved, or at least talked about, I would be fully supportive of this. The Plans look amazing. I <br />think Skoda's done a really good job of taking into consideration Highland Road residents' <br />opinions. That was something that was not done the first time around. I appreciate that. Thank <br />you. I look forwaxd to the Village and Council's response to these items. Thank you. <br />Council President Saponaro stated, thank you. Anyone else? <br />Mayor Bodnar stated, I normally don't respond, but the first point you brought up Mr. <br />McDowell, I did want to address that. I am afraid I am responsible for leaving that 55 and over <br />provision in there. I was of the understanding that maybe it was very significant to the residents <br />of Highland Road that you wanted it in there that way, so that is not carved in stone. It seems the <br />more people consider that issue, the less it's wanted in the Agreement, so it doesn't have to stay <br />there. We put this out here now, but it will be on the agenda for three full reads. We just wanted <br />people to start looking at it. I appreciate all of the effort you put into it and that Mrs. Singer has <br />put into it and Stivo. I know you have a lot invested in Highland Road and Mayfield Village so I <br />appreciate all of the effort you have put into this.
