(S) FAILURE TO RETURN FROM LEAVE: The failure of an employee to return to work <br />upon the expiration of FMLA leave of absence will subject the employee to immediate <br />termination, and the Village may recover any health plan premiums during the period of FMLA <br />leave pursuant to Section (0). <br />(T) FRAUDULENT USE OF FMLA LEAVE: An employee who fraudulently obtains FMLA <br />leave from the Village will be subject to immediate termination. <br />(U) LIMITATIONS ON APPLICABILITY OF POLICY: If application of the Family and <br />Medical Leave Act to the Village ceases to be mandated, by amendment or repeal of the Federal <br />enabling legislation or judicial decree, this Policy shall automatically cease to be in effect, except <br />that any employees who are on FMLA leave at that time may complete such leave under the <br />terms and conditions of this Policy. <br />
