I ORDINANCE NO. 2020-04 INTRODUCED BY: Mayor Bodnar AN EMERGENCY ORDINANCE ENACTING NEW SECTIONS 521.14 AND 521.15 OF CHAPTER 521 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE CONCERNING ELECTRONIC SMOKING DEVICES WHEREAS, tobacco use is the leading cause of preventable death in the United States; and WHEREAS, persons under the age of eighteen (18) are prohibited by law from purchasing or possessing cigarettes and other tobacco products, and retailers are prohibited from selling them to minors. New tobacco -less products, however, commonly referred to as "electronic cigarettes," e-cigarettes,"e-cigars," "e -cigarillos," "e -pipes," "e -hookahs," or electronic nicotine delivery systems," allow the user to simulate cigarette smoking. These products may be purchased by minors and are being marketed without age restrictions or health warnings and come in different co flavors that appeal to young people; and WHEREAS, initial studies by the FDA have determined that e -cigarettes and similar devices can increase nicotine addiction among young people and contain chemical ingredients known to be harmful, which may expose users and the public to potential health risks; and WHEREAS, it has become necessary to regulate electronic smoking device use of persons under the age of eighteen (18) within the Village of Mayfield; and WHEREAS, the purpose of this Ordinance is to protect the public health, safety and welfare of the property and persons in the Village of Mayfield by prohibiting persons under eighteen (18) years of age from possessing and using electronic smoking devices, and prohibiting the sale of electronic smoking devices to persons under the age of eighteen (18) years of age. NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, Cuyahoga County, State of Ohio that: SECTION 1. Section 521.14 and Section 521.15 of the Village's Codified Ordinances is enacted to read as fully set forth in Exhibit "A" attached hereto and incorporated herein by reference.
