I <br />ORDINANCE NO. 2020-04 <br />INTRODUCED BY: Mayor Bodnar <br />AN EMERGENCY ORDINANCE <br />ENACTING NEW SECTIONS 521.14 AND 521.15 OF CHAPTER 521 <br />OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE <br />CONCERNING ELECTRONIC SMOKING DEVICES <br />WHEREAS, tobacco use is the leading cause of preventable death in the United States; and <br />WHEREAS, persons under the age of eighteen (18) are prohibited by law from purchasing or <br />possessing cigarettes and other tobacco products, and retailers are prohibited from selling them <br />to minors. New tobacco -less products, however, commonly referred to as "electronic cigarettes," <br />e-cigarettes,"e-cigars," "e -cigarillos," "e -pipes," "e -hookahs," or electronic nicotine delivery <br />systems," allow the user to simulate cigarette smoking. These products may be purchased by <br />minors and are being marketed without age restrictions or health warnings and come in different <br />co flavors that appeal to young people; and <br />WHEREAS, initial studies by the FDA have determined that e -cigarettes and similar devices <br />can increase nicotine addiction among young people and contain chemical ingredients known to <br />be harmful, which may expose users and the public to potential health risks; and <br />WHEREAS, it has become necessary to regulate electronic smoking device use of persons under <br />the age of eighteen (18) within the Village of Mayfield; and <br />WHEREAS, the purpose of this Ordinance is to protect the public health, safety and welfare of <br />the property and persons in the Village of Mayfield by prohibiting persons under eighteen (18) <br />years of age from possessing and using electronic smoking devices, and prohibiting the sale of <br />electronic smoking devices to persons under the age of eighteen (18) years of age. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, <br />Cuyahoga County, State of Ohio that: <br />SECTION 1. Section 521.14 and Section 521.15 of the Village's Codified Ordinances is <br />enacted to read as fully set forth in Exhibit "A" attached hereto and incorporated herein by <br />reference. <br />
