Minutes of the Special Meeting of Council <br />Monday, November 18, 2019 <br />Page 2 <br />When they are done, whoever they are, we will ask those who are opposed to the zoning matter <br />to also address the Council body. We will let those folks speak as well. After that, we will close <br />the public portion of that matter on the agenda and if the Council members have questions, we <br />can discuss those then. They won't be taking action at this time. There is a regular Council <br />meeting after this, but that's the ground rules for the public hearing. If anyone has any questions, <br />I can answer them now or we can proceed. <br />• PRESENTATION BY REPRESENTATIVES OF GEORGIAN MEDICAL <br />ARTS II, LLC <br />Council President Saponaro stated, all right. Now we will have a presentation by the <br />representatives of Georgian Medical Arts II, LLC. If you can please go to the podium, state your <br />name and address for the record. <br />Dennis Nevar <br />Kenneth Fisher, LPA <br />2100 Terminal Tower <br />50 Public Square <br />Cleveland, Ohio 44113 <br />Also in attendance with me are Dr. Yoram Moyal, the property owner and Ed Parker of Meld <br />Architects. This ordinance requests the rezoning from the single-family residence district to the <br />office -laboratory district. Mr. Parker will go through the proposed project development here <br />with you all shortly. We are looking for an office -laboratory rezoning. Certainly pursuant to the <br />Charter, this will have to go to the electorate hopefully within the time limitations we are dealing <br />with, at the March 17, 2020 election. <br />We are in active negotiations with the Village in regard to a Development Agreement. We are <br />still working on a couple points in there. Specifically as it currently stands, the Village is <br />requesting that construction commence within 12 months of the rezoning with a potential 12 <br />month extension at the Village's discretion. We contend that that time limitation is a little short <br />here because we certainly need to come back to the Village in the event that rezoning is <br />approved and work through the administrative approval process including, without limitation, a <br />conditional use permit for this property. We are also working on a couple of issues relative to <br />potential traffic issues and infrastructure which we would like to see as part of the administrative <br />approval process and not carry forward after construction has been completed and certificate of <br />occupancy issued. <br />In short, before I turn this to Dr. Moyal, I would request that Ordinance 2019-17 be approved <br />and this issue be submitted to the electorate at the March 17, 2020 election. <br />Mr. Coyne stated, if I could just chime in briefly. The issue of the Development Agreement will <br />probably be discussed at the Council meeting this evening so we don't need to address that as it <br />relates to the zoning change in front of the body tonight. We will at the next meeting in an hour. <br />
