RESOLUTION NO. 2022-12 <br />INTRODUCED BY: Mayor Bodnar <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING THE DEPOSIT OF PHOTO ENFORCEMENT REVENUE <br />GENERATED FROM THE VILLAGE'S ADOPTION OF <br />CODIFIED ORDINANCE CHAPTER 317 <br />TO CAPITAL IMPROVEMENT FUND 410 <br />WHEREAS, in order to enhance officer safety and have a substantial impact on the unsafe <br />motorists traveling on I-271, the Mayfield Village Police Chief recommended establishing a photo <br />enforcement program to supplement traditional traffic enforcement operations in the Village; and <br />WHEREAS, based upon the Police Chief's recommendation, Mayfield Village Council <br />adopted Chapter 317 of the Village's Codified Ordinances entitled" Officer -Operated Handheld <br />Traffic Law Enforcement Devices" and authorized entering into the necessary agreements with <br />vendors to facilitate and implement the photo enforcement program; and <br />WHEREAS, now that the photo enforcement program is operational, based upon the <br />recommendation of the Police Chief and Finance Director, it is deemed in the best interest of the <br />Village and its residents to deposit revenues generated from the photo enforcement program to the <br />Capital Improvement Fund- Fund 410 to be used for law enforcement expenses that enhance the <br />response to traffic incidents and improve enforcement of traffic safety laws, as well as for other <br />Village capital needs as may be approved by Council from time to time. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, that: <br />SECTION 1. Mayfield Village Council hereby authorizes and directs the deposit of <br />revenue generated from the photo enforcement program implemented by Chapter 317 of the <br />Village's Codified Ordinances to the Capital Improvement Fund- Fund 410 to be used for law <br />enforcement expenses that enhance response to traffic incidents and improve enforcement of <br />traffic safety laws, as well as for other Village capital needs as may be approved by Council from <br />time to time. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting in such formal action, took place <br />in meetings open to the public, in compliance with all statutory requirements, including <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
