Easement, or the application of such provision, or portion thereof, to any other persons <br />or circumstances shall not be affected thereby and each provision of this Easement shall <br />be valid and enforceable to the fullest extent permitted by law. <br />(i) Whenever required by the context of this Easement, (i) the singular shall include the <br />plural, and vice versa, and the masculine shall include the feminine and the neuter <br />genders, and vice versa; and (ii) use of the words "including", "such as", or words of <br />similar import, when following any general term, statement or matter shall not be <br />construed to limit such statement, term or matter to specific items, whether or not <br />language of non -limitation, such as "without limitation', or "but not limited to", are <br />used with reference thereto, but rather shall be deemed to refer to all other items or <br />matters that could reasonably fall within the broadest scope of such statement, terms <br />or matter, and shall be construed as terms of illustration, not terms of limitation. <br />(j) Each party, respectively, hereby represents and warrants that it has the authority to <br />enter into this Easement and that all necessary actions have been taken to authorize <br />each party to execute this Easement. Each person signing on behalf of a party <br />individually warrants his or her authority to do so and individually warrants that the <br />party on whose behalf he or she is signing has taken all necessary actions to authorize <br />the execution of this Easement. <br />(k) The recitals contained in this Easement are incorporated in this Easement as if fully <br />rewritten herein. <br />(1) This Easement may be executed in two counterparts, each of which shall be considered <br />an original, but such counterparts shall constitute one and the same instrument. <br />[The remainder of this page is intentionally blank.
