J RESOLUTION NO. 2022-39 INTRODUCED BY: Mayor Bodnar AN EMERGENCY RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND PRESIDENT OF COUNCIL TO EXECUTE THE SETTLEMENT PARTICIPATION FORM IN ORDER TO PARTICIPATE IN THE JANSSEN SETTLEMENT WHEREAS, the opioid epidemic resulted in litigation against numerous drug manufactures for damages incurred as a result the opioid epidemic; and WHEREAS, on July 21, 2021, a settlement was reached with Janssen that provided for funds to be distributed to certain government entities for damages incurred as a result of the opioid epidemic; and WHEREAS, Mayfield Village is eligible to receive certain funds through the Janssen settlement and in order to participate in the settlement is required to enter into a settlement participation form; and WHEREAS, this Council finds it to be in the best interest of the health, safety and welfare of the Village of Mayfield to elect to participate in the Janssen settlement. BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, that: SECTION 1. Mayfield Village Council hereby authorizes and directs the Mayor and President of Council to enter into the Settlement Participation Form set forth in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements, including requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that it is necessary for time sensitive litigation.
