RESOLUTION NO. 2023-42 (as amended) INTRODUCED BY: Mayor Bodnar AN EMERGENCY RESOLUTION DECLARING IT NECESSARY TO IMPROVE THE AINTREE PARK, AINTREE NORTH AND SANDALWOOD NEIGHBORHOODS BY REPLACING DAMAGED, CRACKED AND UNEVEN SIDEWALK BLOCKS WHERE NECESSARY, ALL TOGETHER WITH ANY NECESSARY APPURTENANCES THERETO BY THE OWNERS OF THE LOTS OR LAND ABUTTING THEREON AND DECLARING AN EMERGENCY WHEREAS, Section 729.01 ofthe Ohio Revised Code provides that the legislative authority of a municipal corporation may require the construction or repair of sidewalks within the municipal corporation by the owners of lots or lands abutting thereon, and upon the failure of such owners to construct or repair such sidewalks, within the time prescribed in the resolution adopted under section 729.02 ofthe Revised Code, may cause such sidewalks, to be constructed or repaired and assess the total cost thereofagainst the lots or lands abutting thereon; and [See also Chapter 903 ofthe Mayfield Village Code] WHEREAS, the Administration has advised Council, and has deemed it is necessary to replace certain sidewalks within the Village; and WHEREAS, pursuant to Section 729.02 of the Ohio Revised Code, when it is deemed necessary by a municipal corporation to require the construction or repair of sidewalks within the municipal corporation by the owners of the lots or lands abutting thereon, the legislative authority of the municipal corporation shall cause plans, specifications, and an estimate of the cost of such construction or repair to be prepared, showing the location and dimensions of such sidewalks, and the specifications for the construction or repair thereof, and have filed in the office of the clerk of the legislative authority; and WHEREAS, the Village Engineer has caused plans, specifications, and an estimate of the cost of such construction or repair to be prepared, showing the location and dimensions of such sidewalks and the specifications for the construction or repair thereof, and has filed them in the office ofthe clerk ofthe legislative authority; and WHEREAS, the Clerk of Council is in receipt of such plans, specifications, and an estimate of the cost of such construction or repair to be prepared, showing the location and dimensions of such sidewalks and the specifications for the construction or repair thereof; and WHEREAS, Section 729.02 of the Ohio Revised Code requires that after such plans, specifications, and estimate of cost have been filed, as provided in this section, the legislative authority may declare the necessity for the construction or repair ofsuch sidewalks, by the adoption ofa resolution. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT:
