Minutes of the Regular Meeting of Council <br />Monday, May 20, 2024 <br />Page 10 <br />Ms. Calta stated, we encouraged anyone that could to attend this meeting tonight or to send <br />comments. <br />Mr. Arndt stated, this was just strictly over the e-mail. Thank you. <br />Mr. Murphy stated, a couple of questions. If this were tabled to a specific time, let's just say a <br />month, can somebody come in here and open a dispensary tomorrow? The second question is that <br />a short moratorium would hold everything to let us vote on it in the future, is that correct? <br />Ms. Calta replied, for the first question, because of the way they are rolling out the permits and <br />existing facilities are getting the first tranche of licensure, I don't see someone coming in tomorrow <br />and saying, I am opening up an establishment. However, that could happen. <br />Mr. Murphy asked, what if we tabled it for a year? <br />Ms. Calta replied, that's the concern. If someone comes in, we don't have any regulations in place. <br />We have not identified zoning districts. We have not done the due diligence like the Eastlake <br />ordinance where they have addressed what could be concerns or what might not be concerns but <br />at least to go through that analysis. Tomorrow someone could come in. The next round of permits <br />people are going to have to be identifying locations and they are going to be asking about zoning <br />and things like that. My preference is if it's going in a different direction other than prohibiting it <br />outright for all establishments, we need to work out an ordinance that addresses what we are going <br />to permit and where we are going to permit it and what that process looks like. That's why we <br />wanted to identify some of the zoning districts in the area so you can see what you are looking at. <br />You have some of the business district, the retail areas, that could support an area for a dispensary <br />for example because a dispensary would be considered retail use just like a CVS Pharmacy. In <br />those areas where you are not prohibited by the 500 foot restriction from schools and churches and <br />playgrounds and preschools and daycares. <br />Mr. Arndt stated, no one can move into that CVS because it's too close in the distance to the <br />school. <br />Ms. Calta stated, I did the measurement and it's based upon the language in the State Code which <br />said it goes from the property lines and I did it with the scale from the zoning map. It's an estimate <br />but I think it's a pretty good estimate to say that where that CVS is and that entire strip over falls <br />within the prohibition of the 500 feet. The strip where the Village Butcher is is outside of the 500 <br />feet. Where Pizzazz is, that is outside the 500 feet. Those are limited business districts. That's <br />where you get your retail. Those would be areas that without anything on our books someone <br />could come in and say, I am permitted in that area. That's where it comes in to maybe we are not <br />studying, we have all the information but looking at putting together a comprehensive ordinance <br />that addresses that this isn't the area it goes in because the State permits us to do that. <br />Mr. Murphy asked, if we tabled this, let's say for a year, could someone come in and open a <br />dispensary without having to go to Mayfield Village Planning and Zoning or any of the above? <br />
