WfiEREAS, The-City.of Cleeeland, Ohio, despite.its so-called No-Sewer ' No-Water,Policy,,,has_entered_into an agreement in writing, dated April 10, ? 1961? with owners of proper.ty in Dr. F• a, Sowin*s Subdivision.of part of I Original.Mayfield Township Zot No. 20, Tract No. 2, as shown by the recosded plat in Vol[nne 135 of Maps, Fage 39 0Z. Cuyatioga County Records, providing that those owner$ o€ property i.n said subdivision who signed said agreement shall pay to the City of Cleveland, uponbilling for water, the euatomary , and prevailing sc:wage eharge.as may be determined.from time..to time_as though conneeted to the Glevelatid Sewage System, said sums to be retained by the City I of Cleveland until such time as the Village oE Mayiield, the city or the property ? owners shall contract f or the constrtiction o£ sanitary sewers to beneiit said ? property* and.£urther.providing that? when the coatract £or sueh construction ? has been`entered into, thea snch funds as have besn collected, without"interest, ? shall be.made available to the contracting..party.for such.eonstraation; and WfiEREAS, said.. agreement .3.ffi writin,g furt'aer provides that no owner of premises_in said described area slaall be permitted to tap into the water main to.be coastsucted unless said owner signs said.agreement and continnes to pay the sewage charges.attributable to his premises; and WHEREAS, this agreement makes it possible £or property owners to obtain much needed water, even though there are not now sanitary sewers in existence„ and Council deems this bene.f icial to the Di.llage of Mayfield and its inhabitaats, NOW TEIEFtEFORE ' BE IT RESOLVED , BY THE . The Couftcil of the,.Village of Mayf ield, Ohio' hereby approves the abov?e?described agreement_in rariting, dated April 10, 1961, between the City of Cleveland and proper.ty owners in the above described subdivision; provided, however, that in granting such approval the Village of Mayf ield does aot bind itse1f to Construct sewers in subdivi.sion, and further does nat bind itself to construct water mains anless it is legally and financially possible to assess the entire cost thereof against the benef ited propesty.
