ORDINANCE N0. 84-'38 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />AN ORDINANCE AUTHORIZING THE MAYOR <br />AND DIRECTOR OF FINANCE TO ENTER <br />INTO A COOPERATION AGREEMENT WITH <br />THE CUYAHOGA COUNTY BOARD OF <br />COMMISSIONERS FOR THE UTILIZATION <br />OF FUNDS MADE AVAILABLE BY THE <br />HOUSING AND COMMUNITY DEVELOPMENT <br />ACT OF 1974 AND DECLARING AN <br />EMERGENCY. , <br />WHEREAS, the Housing and Community Development Act of 1974 <br />provides an entitlement of funds for community development purposes <br />for urban counties; and <br />WHEREAS, Cuyahoga County may be designated as an urban <br />county provided that it secures Cooperation Agreements with various <br />municipalities in Cuyahoga County; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio, <br />encourage the use of "Urban County Entitlement Funds" for needed <br />public improvement in Cuyahoga County and its municipalities; and <br />WHEREAS, no less than forty percent (40~) of the total <br />"Urban County Entitlement Funds" for Cuyahoga County will be expended <br />by the Cuyahoga County Board of Commissioners on behalf, of the parti- <br />cipating municipalities to finance eligible community development <br />activities, programs and projects in said participating municipali- <br />ties; and <br />WHEREAS, the distribution of the funds made available <br />through the above policy shall be allocated and expended on behalf of <br />each participating municipality for plans, programs and projects <br />eligible under the provisions of the Housing and Community Development <br />Act of 1974; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Council of Mayfield Village, Ohio, <br />authorizes the Mayor and Director of Finance to enter into a coopera- <br />tion agreement with the Cuyahoga County Board of Commissioners for the <br />period commencing the first day of the eleventh program year, <br />October 1, 1985, through and including the last day of the thirteenth <br />program year, September 30, 1988, as described by the Application for <br />FY 1987 funds. Mayfield Village may rescind the Agreement on the <br />first day following the end of each program year only in the event <br />that the County fails to qualify as an urban county or the county does <br />not receive a grant in any year of the aforementioned FY 1985, 1986, <br />and 1987 program year. <br />
