" ,r AN ORDINANCE ENACTING SECTION 501.999 OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, REQUIRING CERTAIN INMATES CONFINED TO MUNICIPAL JAIL, PRISON, WORKHOUSE OR COUNTY JAIL TO REIMBURSE THE MUNICIPALITY FOR ITS EXPENSES INCURRED AS A RESULT OF SAID CONFINEMENT AND DECLARING AN EMERGENCY. WHEREAS, the Ohio General Assembly has enacted Amended Sub. H.B. 363 which became effective September 26, 1984; and WHEREAS, said House Bill authorizes this Council to require any person convicted of an offense other than a minor misdemeanor to reimburse the municipality for expenses incurred by reason of such confinement including, but not limited to, expenses relating to the provision of food, clothing, and shelter; and WHEREAS, pursuant to the provisions of said House Bill the reimbursement may be required if confinement is in a municipal jail, workhouse, prison or county jail; and WHEREAS, said House Bill further authorizes this Council to direct the Director of Law to institute an appropriate civil action to recover the expenses incurred by the municipality as a result of said confinement if the prisoner fails to pay; and WHEREAS, the provisions of said House Bill, if implemented, will benefit the taxpayers of this municipality by requiring those defendants able to pay to reimburse the Village for confinement costs thereby alleviating the burden on taxpayers to pay the cost for those who violate the law within the municipality; now, theref ore, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: Section 1. Section 501.999 of the Codified Ordinances of Mayfield Village, Ohio, is hereby enacted to read as follows: 501.999 Reimbursement for Confinement Costs. (a) Any person convicted of an offense other than a minor misdemeanor and who is thereafter confined in a municipal jail, workhouse, prison or county jail shall reimburse this municipality for its expenses incurred by reason of said confinement including, but not limited to, the expenses relating to the provision of food, clothing, and shelter. The amount of reimbursement shall be determined by a court of competent jurisdiction in an amount and in the manner as provided by law.
