' ORDINANCE NO. 84-42 <br />INTRODUCED BY: ~ MAYOR CARMEN AND- COUNCIL AS A WHOLE.' " <br />,r <br />AN ORDINANCE ENACTING SECTION 501.999 OF THE <br />CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, <br />REQUIRING CERTAIN INMATES CONFINED TO MUNICIPAL <br />JAIL, PRISON, WORKHOUSE OR COUNTY JAIL TO <br />REIMBURSE THE MUNICIPALITY FOR ITS EXPENSES <br />INCURRED AS A RESULT OF SAID CONFINEMENT AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Ohio General Assembly has enacted Amended Sub. <br />H.B. 363 which became effective September 26, 1984; and <br />WHEREAS, said House Bill authorizes this Council to require <br />any person convicted of an offense other than a minor misdemeanor to <br />reimburse the municipality for expenses incurred by reason of such <br />confinement including, but not limited to, expenses relating to the <br />provision of food, clothing, and shelter; and <br />WHEREAS, pursuant to the provisions of said House Bill the <br />reimbursement may be required if confinement is in a municipal jail, <br />workhouse, prison or county jail; and <br />WHEREAS, said House Bill further authorizes this Council to <br />direct the Director of Law to institute an appropriate civil action to <br />recover the expenses incurred by the municipality as a result of said <br />confinement if the prisoner fails to pay; and <br />WHEREAS, the provisions of said House Bill, if implemented, <br />will benefit the taxpayers of this municipality by requiring those <br />defendants able to pay to reimburse the Village for confinement costs <br />thereby alleviating the burden on taxpayers to pay the cost for those <br />who violate the law within the municipality; now, theref ore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Section 501.999 of the Codified Ordinances of <br />Mayfield Village, Ohio, is hereby enacted to read as follows: <br />501.999 Reimbursement for Confinement Costs. <br />(a) Any person convicted of an offense other than a minor <br />misdemeanor and who is thereafter confined in a municipal <br />jail, workhouse, prison or county jail shall reimburse <br />this municipality for its expenses incurred by reason of <br />said confinement including, but not limited to, the expenses <br />relating to the provision of food, clothing, and shelter. <br />The amount of reimbursement shall be determined by a court <br />of competent jurisdiction in an amount and in the manner as <br />provided by law. <br />
