RESOLUTION N0. 82- 46 <br />INTRODUCED BY: Iviayor and C-ouncil as allhole <br />A RESOLUTION OPPOSING.THE PASSAGE OF HOUSE BILL <br />N0. 722 PRESENTLY PENDING BEFORE THE 114th <br />GENERAL ASSEMBLY IN COLUMBUS, OHIO. <br />WHEREAS, House Bill No. 722 proposes to amend Section 2935.22 <br />of the Ohio Revised Code to require that an offense be charged <br />and prosecuted as a violation of a municipal ordinance if the <br />offense is a violation of both the municipal ordinance and State <br />statute and is punishable as a misdemeanor; and <br />IJHEREAS, it appears that the intent of the Ohio Legislature, <br />in the introduction and consideration of this Bill, is to pass <br />along to cities the costs of housing prisoners, when such prisoners <br />are, in fact, charged under State Code, if such prisoners could <br />also be, or have been charged under similar municipal ordinances; <br />and <br />WHEREAS, the State of Ohio, through the Department of <br />Correction and Rehabilitation, has in the recent past, established <br />stringent jail standards that are extremely difficult for any <br />municipal corporation to meet; and <br />WHEREAS, those State jail standards make it very difficult <br />for a municipality to house prisoners for the violation of any <br />misdemeanor; and <br />WHEREAS, it is the desire of this Council to go on record <br />opposing House Bill Noe 722 and to, at the'same time, urge the <br />Legislature to have concern for local municipal corporations <br />rather than to continually protect the State of Ohio from costly <br />prisoner housing, wh'i1e at the same time, failing to take any <br />corrective steps relative to the erifor.cemerit of overburderisome, <br />and often time, ridiculous, jail standards; now, therefore, <br />BE IT RESOLVED BY THE COUPICIL OF MAYFZELD VILLAGE, OHIO, THAT: <br />Section 1. That the Council and the administration of <br />Mayfiel Vi lage hereby urge the State General Assembly to defeat <br />House Bill No. 722, and, at the same time, to commence a thorough <br />examination of the minimum acceptable standards for housing <br />prisoners and the unnecessary and overburderisom requirements that <br />have previously beeri established by the recerit adoption of minimum <br />jail standards for Oh'io. <br />Section 2. That the Clerk of Council be and she is hereby <br />directe to sen a copy of this Resolution to the Oh'io House and <br />Ohio Senate, to State Representative Jeffrey Dean, to State <br />Senator Ben Skall, to Governor James Rhodes, and to al1 municipal <br />corpora.tions in Cuyahoga County,
