RESOLUTION N0. 82- 66 <br />INTRODUCED BY: Councilman Fred N. Carmen <br />A RESOLUTION URGING THE CONGRE.SS OF THE <br />UNITED STATES TO ENACT H.B. 4808 OR S.B. <br />1758, OR SIMILARLY WORDED JOINT LEGISLATION <br />FROM BOTH HOUSES OF THE CONGRESS, IN ORDER <br />TO PROVIDE THAT THE VIDEO TAPING OF COMMERCIAL <br />PROGRAMS FOR NON-COMMERCIAL PURPOSES BE EXEMPT <br />FROM THE COPYR.IGHT LAWS AND THUS EXEMPT FROM <br />ANY PAYMENT OF ROYALTIES. <br />WHEREAS, H.B. 4808 and S.B. 1758 have been introduced into <br />the Congres.s of the United States; and <br />WHEREAS, the aforementioned bills both propose that the <br />videotaping of commercial programs for non-commercial purposes <br />be exempt from the copyright laws and thus exempt from any payment <br />of royalties to the owner of such a videotaped program; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio, <br />have determined that the videotaping of such programs for private <br />use by individuals or for other non-commercial purposes should be <br />exempt from th:e copyright laws in order to protect the privacy <br />of individuals and to promote greater forms of home entertainment; <br />now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The Mayor and Council of Mayfield Village, Ohio, <br />urge the Congress of the United States to eriact H.B. 4808 or S.B. <br />1758, or some similarly worded joint legislation from both Houses <br />of Congress, in order to provide that the videotaping of commercial <br />programs for non-commercial purposes be exempt from the copyright <br />laws and thus exempt from any payment of royalties to the owner of <br />such a videotaped program. <br />Section 2. The Clerk of Council is hereby authorized and <br />directed to forward copies of this Resolution to Presiderit Ronald W. <br />Reagan, United States Senators Howard Metzenbaum and John Glenn, <br />to all United States Representativesfrom Cuyahoga County and to <br />the Clerks of Council in the Hillcrest area. <br />Section 3. That the Council finds and determines that a11 <br />formal actions of this Council relating to the adoption of this <br />Resolution have been takeri at operi meetings of this Council; and <br />that deliberations of this Council and of i.ts committees, resulting <br />in such formal action, took place in meetings operi to the public, <br />in compliance with all statutory requiremerits, including the <br />requirements of Section 121022 of the Ohio Revised Code.
