RESOLUTION N0. 82-82 <br />INTRODUCED BY: Mayor & Council as a Who1e <br />A RESOLUTION AUTHORIZING THE SETTLEMENT OF <br />LITIGATION BROUGHT AGAINST THE VILLAGE BY <br />J. ROBERT COTTON AND JOAN K. COTTON. <br />WHEREAS, J. Robert Cotton and Joan K. Cotton instituted a <br />civil complaint against the municipality in the Lyndhurst Municipal <br />Court for alleged damages to their property resulting from certain <br />work performed by the municipality in repairing part of the storm <br />sewer drainage system; and <br />WHEREAS, as the result of negotiations conducted between <br />counsel for both parties there has been an agreement reached that <br />the municipality ay to the Cottons the sum of One Thousand Two <br />Hundred Dollars (?1,200.00) as a full and complete settlement of <br />the claims made by the Cottons as set forth hereinabove; and <br />WHEREAS, the Mayor and Council have determined the payment <br />of the stipulated sum is in the best interest of the municipality in <br />order to terminate the litigation and avoid any further liability <br />to the municipality; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The Mayor and Council of Mayfield Village do <br />hereby determine that it is in the best interest of the municipality <br />to settle J. Robert Cotton, et al. v. Village of Mayfield, the same <br />being Case No. 81-CVE- 695, now pen ing in the Lyn urst Municipal Court. <br />Section 2. The Director of Law is authorized and directed to <br />take whatever steps are necessary in order to terminate the pending <br />litigation provided that all necessary parties execute the Judgment <br />Entry and the Release, said documents being attached hereto and <br />marked Exhibit "A" and "B", respectively. <br />Section 3. Upon the successful execution of the aforementioned <br />documents the Director of Finance is hereby authorized and directed <br />to make payment of the sum of One Thousand Two Hundred Dollars ($1,200.00) <br />to J. Robert Cotton and Joan K. Cotton, in the manner specified by <br />the Director of Lawe <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been takeri at operi meetings of this Council; and that <br />deliberations of this Council and vf its committees, resulting in <br />such formal action, took place in meetings open: to the public, in <br />compliance with a11 statutory requiremerits, including the requirements <br />of Section 121.22 of the Ohio Revised Code.
