ORDINANCE N0. 82- 94 <br />INTRODUCED BY: Mayor Robert G. Beebe <br />AN ORDINANCE CONFIRMING THE APPOINTMENT OF <br />A PROSECUTOR, ESTABLISHIrIG CC'MPENSATION <br />THEREFOR, AND DECLARING Ard EMERGENCY. <br />BE IT ORDAINED SY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The Mayor's appointment of Vincent A. Feudo, <br />as Prosecutor or Mayfield Village is hereby confirmed. <br />Section 2. Effective January l, 1983 the Prosecutor shall <br />be compensate at the rate of Five Hundred Twenty-Five Dollars <br />($525.00) per month for al1 services rendered to the municipality <br />in such capacity except as herein otherwise provided. While in <br />attendance at all trials and pretrials in the Lyndhurst Municipal <br />Court on criminal charges brought by Mayfield Village either under <br />its own Codified Ordinances or under the Revised Code of the State <br />of Ohio, and including preliminary hearings in the Lyndhurst Municipal <br />Court on felony charges arising out of Mayfield Village, the Prosecutor <br />sha11 be compensated at the rate of Fifty Dollars ($50.00) per hour, <br />payable upon submission of reasonably detailed billings indicating <br />the nar_ze of the case, the date and nature of the proceeding and the <br />time spent. It is understood that such services are rendered by the <br />Prosecutor as an independent contractor and that he is not an employee <br />of the municipalityo <br />Section 3. This contract shall be effective until December 31, <br />1983 or until the appointment of a successor Prosecutor, whichever is <br />later. <br />Section 4. The Prosecutor shall be responsible directly to <br />the Mayor an sha11 not be under the supervision or control of the <br />Law Director. <br />Section 5. That it is found and determined that al1 formal <br />actions of this Council concerning and relating to the adoption of <br />this Ordinance were adopted in an open meeting of this Council; and <br />that a11 deliberations of th.is Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with al1 legal requirements including Section <br />121e22 of the Ohio Revised Codeo <br />Section 6. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, in that it provides <br />for necessary governmental services.
