ORDINANCE N0. 82- 94 INTRODUCED BY: Mayor Robert G. Beebe AN ORDINANCE CONFIRMING THE APPOINTMENT OF A PROSECUTOR, ESTABLISHIrIG CC'MPENSATION THEREFOR, AND DECLARING Ard EMERGENCY. BE IT ORDAINED SY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section l. The Mayor's appointment of Vincent A. Feudo, as Prosecutor or Mayfield Village is hereby confirmed. Section 2. Effective January l, 1983 the Prosecutor shall be compensate at the rate of Five Hundred Twenty-Five Dollars ($525.00) per month for al1 services rendered to the municipality in such capacity except as herein otherwise provided. While in attendance at all trials and pretrials in the Lyndhurst Municipal Court on criminal charges brought by Mayfield Village either under its own Codified Ordinances or under the Revised Code of the State of Ohio, and including preliminary hearings in the Lyndhurst Municipal Court on felony charges arising out of Mayfield Village, the Prosecutor sha11 be compensated at the rate of Fifty Dollars ($50.00) per hour, payable upon submission of reasonably detailed billings indicating the nar_ze of the case, the date and nature of the proceeding and the time spent. It is understood that such services are rendered by the Prosecutor as an independent contractor and that he is not an employee of the municipalityo Section 3. This contract shall be effective until December 31, 1983 or until the appointment of a successor Prosecutor, whichever is later. Section 4. The Prosecutor shall be responsible directly to the Mayor an sha11 not be under the supervision or control of the Law Director. Section 5. That it is found and determined that al1 formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council; and that a11 deliberations of th.is Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with al1 legal requirements including Section 121e22 of the Ohio Revised Codeo Section 6. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, in that it provides for necessary governmental services.
