ORDINANCE NO. 81-36 <br />INTRODUCED BY : Council as a Whole <br />AN ORDINANCE PROPOSED BY THE VILLAGE COUNCIL <br />SUBMITTING TO THE ELECTORS OF HAYFIELD VILLAGE, <br />OHIO, THE QUESTION AS TO WHETHER THE CHARTER <br />OF HAYFIELD VILLAGE SHOULD BE AMENDED TO <br />PROVIDE FOP. SUCCESSION TO THE PRESIDEDICY OF <br />COUNCIL. <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Pursuant to Article X of the Charter of Mayfield <br />Village, Ohio, the Village Council proposes the following amendment <br />to the Charter of the Village, to be submitted to the electors of <br />the Village at the regular election to be held in the municipality <br />on the 3rd day of November, 1981. The change proposed to the <br />Charter is to add, at the end of Section 15, Article III, thereof, <br />the following sentence: <br />"In the event of a vacancy in the office of President <br />of Council, the President Pro Tem shall automatically <br />succeed to the office of President of Council and <br />Council shall, as early as practicable thereafter, <br />elect a new President Pro Tem." <br />Section 2. The above Charter change shall be submitted <br />to the electors in the following ballot question: <br />"Shall the Charter of Mayfield Village be amended to <br />provide that when there is a vacancy in the office <br />of President of Council the President Pro Tem shall <br />automatically become President of Council?" <br />Section 3. The Clerk of Council is authorized and directed <br />to certify a copy of this Ordinance to the Board of Elections, <br />Cuyahoga County immediately upon its passage for inclusion on the <br />ballot at the general election to be held in the municipality on <br />the 3rd day of November, 1981, and to take such other steps as <br />are required pursuant to .Ohio law to cause such election to be <br />validly held. <br />Section 4. The Law Director is authorized, empowered and <br />directed to confer with the Board of Elections regarding the ballot <br />questions and to make any changes necessary to comply with current <br />election law so long as the substance of the issue is not changed. <br />Section 5. This Ordinance, being authorized by. Charter, <br />shall be passed only upon the affirmative vote of not less than <br />five (5) members elected to Council and approval by the Mayor, and <br />shall thereafter take effect immediately. <br />PASSED• July 20, 1981 Lawrence ~.
