ORDINANCE NO. 81- 42 <br />INTRODUCED BY: Mayor & Council as a Whole <br />AN ORDINANCE CONFIRMING THE APPOINTMENT OF <br />A LAW DIRECTOR; ESTABLISHING TERMS, CONDITIONS <br />AND COMPENSATION FOR SUCH SERVICES; AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Council of Mayfield Village, Ohio, has confirmed <br />the appointment of DALE C. FENELI to the position of Law Director; <br />and <br />WHEREAS, said Council wishes to and hereby does establish <br />the terms, conditions and compensation for such employment; now, <br />therefore, <br />BE IT ORDAINED BY ^1 HE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. As Law Director of Mayfield Village, Ohio, <br />DALE C. FENELI shall be responsible for the administration of all <br />civil, municipal legal: matters and shall perform all duties <br />specified by the Charter of Mayfield Village, Ohio, with regard <br />to the Director of Law and by the statutes of the State of Ohio <br />with regard to the duties of City Solicitors. The Director of <br />Law shall not be responsible, however, for the conduct nor <br />compensation of the Municipal Prosecutor, who shall be separately <br />appointed, directed and compensated. <br />Section 2. The Law Director shall personally conduct or <br />directly supervise all activities for which he is responsible. <br />In any event, attendance at meetings of Council shall be the sole <br />and exclusive responsibility of the Law Director except as hereinafter <br />stated and all adversary litigation shall be conducted personally <br />by the Law Director except where otherwise provided. In the event <br />of absence from meetings of Council by reason of illness, personal <br />emergency, vacation or unavoidable absence from Cuyahoga County <br />on other non-municipal business, or in the event of being unable <br />to conduct litigation by reason of illness or personal emergency, <br />DALE C. FENELI shall cause all services necessary to=the municipality <br />to be rendered by a qualified attorney licensed to practice law <br />in the State of Ohio and having municipal legal experience, all <br />at DALE C. FENELI's sole expense. <br />Section 3. The charges to the municipality for services to <br />be rendered by the Law Director shall be as follows: <br />(a) For attendance at regular Council meetings, <br />Council Caucuses, and the regular meeting of the Planning <br />Commission, plus such other meetings of Boards, Commissions <br />and Council at which the attendance of the Law Director <br />is requested, not to exceed four (4) meetings per month, <br />
