ORDINANCE NO. 81- 43 INTRODUCED BY: Mayor and Council'as a Whole AN ORDINANCE LEVYING ASSESSMENTS FOR THE PAYMENT OF STREET LIGHTING AND THE IMPROVEMENT OR INSTALLATION OF ADDITIONAL LIGHTING BY SPECIAL ASSESSMENT OF ALL PARCELS BENEFITED, AND DECLARING AN EMERGENCY. WHEREAS, this Council did adopt Resolution 81-41 on August 4, 1981, declaring therein, the necessity to provide for the payment of street lighting and the improvement or installation of additional lighting by special assessment of all parcels benefited; and WHEREAS, pursuant to said Resolution the Village Engineer did prepare and`file with the Office of the Clerk of this Council estimated assessments for the costs of said improvement showing thereon the amount of the assessment against each lot or parcel of land to be assessed; and WHEREAS, notice of the passage of said Resolution and the filing of the estimated assessments was published in a newspaper of general circulation in the municipality on the 13th and 20th days of August, 1981,-all according to law; and WHEREAS, there having been no objections to the estimated assessments filed following the publication of notice as aforesaid; now, therefore BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: Section 1. The cost and expense of improving certain public thoroughfares in Mayfield Village, Ohio, and other public areas within said Village, by lighting the same with sizes of lamps at the locations indicated' on the plans in the office of the Clerk of this Council, and of maintaining and operating the existing street lighting facilities within Mayfield Village, Ohio, is to be assessed at the rate of .7 mills to be levied against all parcels indicated in the list of assessments attached hereto and incorporated herein as if fully rewritten, the same having been prepared by the Village Engineer and which are hereby adopted and confirmed by this Council, which assessments are in direct proportion to the tax value thereof and are not in excess of the statutory limitations.. Section 2. Council hereby determines that the said assessments which are now on file in the office of the Clerk of this Council are in the same proportion to the estimated assessments as originally filed as the costs of the above-described improvement is to the estimated cost of the improvement as originally filed.
