ORDINANCE NO. 81- 43 <br />INTRODUCED BY: Mayor and Council'as a Whole <br />AN ORDINANCE LEVYING ASSESSMENTS FOR THE PAYMENT <br />OF STREET LIGHTING AND THE IMPROVEMENT OR <br />INSTALLATION OF ADDITIONAL LIGHTING BY SPECIAL <br />ASSESSMENT OF ALL PARCELS BENEFITED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council did adopt Resolution 81-41 on August <br />4, 1981, declaring therein, the necessity to provide for the <br />payment of street lighting and the improvement or installation of <br />additional lighting by special assessment of all parcels benefited; <br />and <br />WHEREAS, pursuant to said Resolution the Village Engineer <br />did prepare and`file with the Office of the Clerk of this Council <br />estimated assessments for the costs of said improvement showing <br />thereon the amount of the assessment against each lot or parcel <br />of land to be assessed; and <br />WHEREAS, notice of the passage of said Resolution and the <br />filing of the estimated assessments was published in a newspaper <br />of general circulation in the municipality on the 13th and 20th <br />days of August, 1981,-all according to law; and <br />WHEREAS, there having been no objections to the estimated <br />assessments filed following the publication of notice as aforesaid; <br />now, therefore <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The cost and expense of improving certain <br />public thoroughfares in Mayfield Village, Ohio, and other public <br />areas within said Village, by lighting the same with sizes of <br />lamps at the locations indicated' on the plans in the office of <br />the Clerk of this Council, and of maintaining and operating the <br />existing street lighting facilities within Mayfield Village, Ohio, <br />is to be assessed at the rate of .7 mills to be levied against <br />all parcels indicated in the list of assessments attached hereto <br />and incorporated herein as if fully rewritten, the same having <br />been prepared by the Village Engineer and which are hereby adopted <br />and confirmed by this Council, which assessments are in direct <br />proportion to the tax value thereof and are not in excess of the <br />statutory limitations.. <br />Section 2. Council hereby determines that the said <br />assessments which are now on file in the office of the Clerk of <br />this Council are in the same proportion to the estimated assessments <br />as originally filed as the costs of the above-described improvement <br />is to the estimated cost of the improvement as originally filed. <br />
