ORDINANCE NO. 80- 21 <br />INTRODUCED BY: Counci 1 as a VJho.le <br />AN EMERGENCY ORDINANCE AUTHORIZING THE GRANTING <br />OF AN EASEMENT FROM HAYFIELD VILLAGE TO ADELINE <br />KRENZLER, TRUSTEE, HENRY J. SCHMIDT AND THE <br />HAYFIELD VILLAGE RACQUET CLUB, INC., FOR THE USE <br />OF A CERTAIN CHANNELED STREAM FOR THE TRANSPORTATION <br />OF STORM WATER AND SURFACE DRAINAGE. <br />WHEREAS, this Council has authorized the construction of <br />a Municipal Service Building within Mayfield Village; and <br />WHEREAS, in connection with the construction of said <br />building Mayfield Village will be widening and extending a certain <br />channeled stream on its property in an Easterly direction from the <br />Northern boundary of the land owned by Adeline Y.renzler, Trustee, <br />and leased to Henry J. Schmidt and the Mayfield Village Racquet <br />Club, Inc.; and <br />WHEREAS, the said Adeline Krenzler, Trustee, Henry J. <br />Schmidt and the Mayfield Village Racquet Club, Tnc. have requested <br />from Mayfield Village an easement in, underneath and through its <br />land for the purpose of using said channeled stream for the trans- <br />portation of storm water and surface drainage; and <br />WHEREAS, the said Adeline Krenzler, Trustee, Henry J. <br />Schmidt and the Mayfield Village Racquet Club, Inc. have granted <br />to Mayfield Village an easement in, underneath and through the land <br />owned by and leased to the above-stated parties for the use, maintenance, <br />repair and replacement of a certain sanitary sewer line; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Finance Director are hereby <br />authorized, empowered and directed to execute the Channeled Stream <br />Easement which is attached hereto and incorporated herein as if fully <br />rewritten, the same granting to Adeline Krenzler, Trustee, Henry J. <br />Schmidt and the Mayfield Village Racquet Club, Inc. an easement in, <br />underneath and through a portion of the land belonging to Mayfield <br />Village and constituting a certain channeled stream for the purpose <br />of transporting storm water and surface drainage, all of which is more <br />fully described in the attached document. <br />Section 2. This ordinance is declared to be an emergency <br />measure immediately necessary for the preservation of the peace, health, <br />safety and welfare of the residents of Mayfield Village in that it will <br />aid in the effective drainage of surface water within the municipality. <br />It shall therefore take effect immediately upon passage by the <br />
