yr ~ ~~=:.mac.; t ~ ;_;- ~,- ~ ._ <br />ORDINANCE NO. 80- 36 <br />INTRODUCED BY: Mr. Flynn <br />AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR AND <br />DIRECTOR OF FINANCE TO TERMINATE THE EXISTING <br />MUTUAL AID FIRE PROTECTION AGREEMENT WITH THE <br />VILLAGE OF GATES MILLS AND FURTHER AUTHORIZING <br />THE EXECUTION OF A NEW MUTUAL AID FIRE AGREEMENT <br />WITH SAID MUNICIPALITY. <br />WHEREAS, this Council passed Ordinance No. 80-4 on January <br />21, 1980 authorizing the Mayor and Director of Finance to enter <br />into a Mutual Aid Fire Protection Agreement with the Village of <br />Gates Mills, Ohio; and <br />WHEREAS, the Council of the Village of Gates Mills passed <br />Ordinance No. 1972 on March 10, 1980 authorizing the President Pro <br />Tem of Council and Clerk of the Village to enter into a Mutual Aid <br />Fire Protection Agreement with Mayfield Village, Ohio; and <br />WHEREAS, the respective public officials from each of the <br />municipalities as hereinabove specified. did enter into a Mutual Aid <br />Fire Protection Agreement with each other in a form approved by <br />their respective Law Directors; and <br />WHEREAS, it has become an overly burdensome financial <br />obligation of Mayfield Village to supply mutual aid fire protection <br />for the Village of Gates Mills without charge as specified in the <br />existing Mutual Aid Fire Protection Agreement; and <br />WHEREAS, the existing Mutual Aid Fire Protection Agreement <br />provides, in Paragraph 6, that said Agreement can be terminated by <br />either party upon the giving of thirty (30) days written notice to <br />the other party; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Director of Finance are hereby <br />authorized, empowered and directed to notify the Village of Gates <br />Mills, in writing, by certified mail, return receipt requested, that <br />effective July 1, 1980 the existing Mutual Aid Fire Protection <br />Agreement executed by and between Mayfield Village, Ohio, and the <br />Village of Gates Mills, Ohio, will be terminated. <br />Section 2. The. Mayor and Director of Finance are hereby <br />authorized and directed to enter into a Mutual Aid Fire Protection <br />Agreement with the Village of Gates Mills in a form substantially <br />similar to the one attached hereto and marked Exhibit "A" following <br />the termination date of the existing agreement. <br />
