Form V - 6~10~47 <br />Ordinance No. %~G $ <br />By Nr. 5 LOitN <br />AI3 ORDINANCE OFFERING TO CONTRACT AND FIXING THE MAXIMUM <br />RATES FUR ELECTRICITY IN THE VILLAGE OF NiAYFIELD, <br />OHIO, FOR A PERIOD OF FOUR YEARS, SUBJECT TO <br />CANCELLATION AFTER THE FIRST TWO YEARS OF SAID TERM, AND <br />TO REPEAL ORDINANCE NO. 2 2 PASSED June 17 , 1g46. <br />WHEREAS, on ~~ July 17 1g44, this Council passed <br />Ordinance No. -~" ~`~- ~ and on June 17 , 1946, passed <br />Ordinance No. 252 , fixing the maximum rates for electricity in <br />the Village of Mayfield f or periods of two <br />years each from the effective dates of said ordinances, and also providing for <br />an adjustment in said rates to conf orm to the lawful rates of The Cleveland <br />Electric Illuminating Company in the City of Cleveland, Ohio, during said <br />periods of time, as established by final determination of lawful authority or <br />by agreement between the City of Cleveland and said Company; and <br />WtIEREAS, on May 12, 1947, the Council of the City of Cleveland <br />passed Ordinance No. 542-47, offering a contract to The Cleveland Electric <br />Illuminating Company whereby the lawful rates for electricity in the City <br />of Cleveland would be settled and~or fixed, as follows: <br />(a) For the period of two years beginning July 7, 1g44, <br />in accordance with the order of The Public Utilities <br />Commission of Ohio dated January 24, 1g47, in Case <br />No. 12604, being the appeal of The Cleveland Electric <br />Illuminating Company from Ordinance No. 338-44 passed <br />by the Council of the City of Cleveland May 22, 1g44; and <br />(b) For the period beginning July 7, 1g46, to the effective <br />date of said Ordinance No. 842-47, and for the period <br />of four years from the effective date of said Ordinance <br />No. 842-.47, subject to the right of cancellation after <br />the first two years of said term, in accordance with <br />the rates and the terms and conditions contained in <br />said Ordinance No. 842-47; and <br />WHEREAS, The Cleveland Eleotric Illuminating Company has duly filed <br />with the Clerk of the Council of the City of Cleveland a written declaration <br />of its intent to accept the offer contained in said Ordinance No. 842-47, and <br />has also filed a written acceptance of the same, within the time and in the <br />manner provided thorein for acceptance, and thereby has entered into a valid <br />and binding contract with the City of Cleveland; and <br />W;r3EREAS, said lawful rates in the City of Cleveland, established as <br />aforesaid, are the same rates as those fixed in Ordinances Nos, 258 and 252 <br />of this Council, except rates for July 1g47 with respect to which rates said <br />settlement ordinance, No. 542-47, provides for a reduction in charges for July <br />1g47 amounting to 85.5% of the March 1g47 bill or the July 1g47 bill, whichever <br />is the greater, of each residential and general commercial (a. c.) customers and <br />WHEREAS, it is in the public interest that the rates for electricity <br />for residential and general commercial use in the Village of Mayfield <br />shall continue to be uniform with those in the City of Cleveland: <br />
