Form V - 6~10~47 Ordinance No. %~G $ By Nr. 5 LOitN AI3 ORDINANCE OFFERING TO CONTRACT AND FIXING THE MAXIMUM RATES FUR ELECTRICITY IN THE VILLAGE OF NiAYFIELD, OHIO, FOR A PERIOD OF FOUR YEARS, SUBJECT TO CANCELLATION AFTER THE FIRST TWO YEARS OF SAID TERM, AND TO REPEAL ORDINANCE NO. 2 2 PASSED June 17 , 1g46. WHEREAS, on ~~ July 17 1g44, this Council passed Ordinance No. -~" ~`~- ~ and on June 17 , 1946, passed Ordinance No. 252 , fixing the maximum rates for electricity in the Village of Mayfield f or periods of two years each from the effective dates of said ordinances, and also providing for an adjustment in said rates to conf orm to the lawful rates of The Cleveland Electric Illuminating Company in the City of Cleveland, Ohio, during said periods of time, as established by final determination of lawful authority or by agreement between the City of Cleveland and said Company; and WtIEREAS, on May 12, 1947, the Council of the City of Cleveland passed Ordinance No. 542-47, offering a contract to The Cleveland Electric Illuminating Company whereby the lawful rates for electricity in the City of Cleveland would be settled and~or fixed, as follows: (a) For the period of two years beginning July 7, 1g44, in accordance with the order of The Public Utilities Commission of Ohio dated January 24, 1g47, in Case No. 12604, being the appeal of The Cleveland Electric Illuminating Company from Ordinance No. 338-44 passed by the Council of the City of Cleveland May 22, 1g44; and (b) For the period beginning July 7, 1g46, to the effective date of said Ordinance No. 842-47, and for the period of four years from the effective date of said Ordinance No. 842-.47, subject to the right of cancellation after the first two years of said term, in accordance with the rates and the terms and conditions contained in said Ordinance No. 842-47; and WHEREAS, The Cleveland Eleotric Illuminating Company has duly filed with the Clerk of the Council of the City of Cleveland a written declaration of its intent to accept the offer contained in said Ordinance No. 842-47, and has also filed a written acceptance of the same, within the time and in the manner provided thorein for acceptance, and thereby has entered into a valid and binding contract with the City of Cleveland; and W;r3EREAS, said lawful rates in the City of Cleveland, established as aforesaid, are the same rates as those fixed in Ordinances Nos, 258 and 252 of this Council, except rates for July 1g47 with respect to which rates said settlement ordinance, No. 542-47, provides for a reduction in charges for July 1g47 amounting to 85.5% of the March 1g47 bill or the July 1g47 bill, whichever is the greater, of each residential and general commercial (a. c.) customers and WHEREAS, it is in the public interest that the rates for electricity for residential and general commercial use in the Village of Mayfield shall continue to be uniform with those in the City of Cleveland:
