ORDIIdANCE No. t~36 <br />By Mr. Waltz <br />AN E +~tGENCY ORDINANCE TO LEVY SPECIAL ASSESSIi~ENTS FOR THE <br />IlUlPROVEME~TT OF WILSON HILi,S ROAD FROIu1_ THE ~'~EST CORPORATION <br />LINE OF NtA,XFIELD VII,LAGE TO THE -V~ESTERLY LINE. OF ECHO DRIVE <br />IN HAYFIELD VILLAC~ BY THE CONSTRUCTION OF A WATER MAIN THEREIN <br />BE IT ORDAINED BY THE COUNCIL OF THE V]ZLAC:E OF HAYFIELD, STATE OF OHIO: <br />Sec. 1. That the assessment of the cost and expense of improving <br />tiVilson Road from the west corporation line of Mayfield Village to <br />the westerly line of Echo Drive in I~yfield Village by the installation <br />of a-water main and appurtenances therein, amotuiting in the aggregate to <br />~~98,69l~.57, as reported to this Council on the 7th day of June, 1953, by <br />the Board heretofore appointed to estimate said assessments, notice of <br />the filing of which assessments has been given as required by law, be <br />and the same is hereby adopted and confirmed, and that there be and there <br />is hereby levied and assessed upon the lots and lands bounding and abutting <br />upon said improvement the several amounts reported as aforesaid, which <br />assessments together with the descriptions of said lots and lands are <br />now on file in the office of the clerk of this Council, and which <br />assessments are in proportion to the special benefits and are not in <br />excess of the special benefits to said property, and are not in excess <br />of any statutory limitation. <br />Sec. 2. That the total assessment against each lot or parcel of <br />land shame payable in cash within thirty (30) days from and after the <br />passage of this ordinance, or at the option of the owner, in ten (10) <br />annual installments with interest at the same rate as shall be borne_on <br />the bonds to b e issued in anticipation of the collection of the same. <br />All cash payments shall b e made to the treasurer of Mayfield Village. All <br />assessments and installments thereof remairLnro unpaid at the expiration <br />of said thirty (30) days shall be certified by the Clerk of the Council <br />to the County Auditor, as provided by law, to be by him placed on the <br />tax duplicate and collected as other taxes are collected. <br />Sec. 3. That this ordinance being an emergency measure for the <br />immediate preservation of the publa.c peace, health and safety of the <br />inhabitants of the Village of Mayfield, Ohio, sha]1 take effect immediately <br />upon its passage and approval as an emergency measure© <br />Passed June 15, 1953. <br />Attest: ~~ ~rf-~~t-°" <br />G~0 .~ P - presi n of Counci <br />SEAL Cle <br />
