ORDINANCE N'O. 7-j By Mr Parker. PROVIDING FOR THE CONSTRUCTION OF SIDE'UdAIKS ON. THE 19ESTERI,Y SIDE OF S. 0. M. CENTER R0.4D FROM • 4VILSON MiLI,S ROAD TO THE NORTIi LINE OF THE BOARD OF IDIICATION PfiOPERTY. 4FHEREAS, this Council did by resolut"ion passed September 17th,1928 order the construction of a sidewalk on t}ie Westerl-y side of ,S.O.M.Center Road from Wilson IVlii.lls Road to the north line of the Board of Education property, and . WIiEI3EAS, pursuant to instructions of the Council, the Village Fngineer has prepared plans,. specifications, profiles and estimates of th cost of se,id 3mprovement all of which are now on file v?ith the Village C?erk, and WHEREAS, property otvners residing or owning property on said S.O.M. Center Road, within the limits aboee peferred to, have been duly and legally served evith notice of said resolution, but said property -owmers have failed to constrnct said sidewalk as reguired by said x°esol.ution, and VJEHERAS, this Courtcil believes and therefore declares it necessary for the public health, peace and safety that sidewalks shall be installed in said street from Wilson IuIills Road on the Westerly side of S-.O.M.Center Road to the North line of-the Board of Education property. Now, Therefore, ? BE IT ORDAINED by the Council of the Village of Mayfield, State of Ohio, three-fourth of a11 members elected thereto concurring; SECTION lo That said plans, specifi.cations, profiles and estimates of eo9t of said improvement be and the saane are hereby approved and aelopted and it is ordered tha.t same shall at all times be kept on file in the office of the Village Clerk open to 3nspection. SECTION 2. 3'his Council hereb3r declares that, sa,id improeement is conducive to the public health, convenience and safety, and is necessary for the preservation of the public health, vFealth and safety. SECTION 3. That it is hereby determined to proeeed with the constructi.on of sidewalks on the westerly side of S..O. M. Center Road from Wilson Wills $oad to the northern line of the Board of Education Propexty; that said sidevralks sha.la be constructed of stone f lagging and in all rsspects aacording to the plans and apecifications naw, on file in the office of this village. SECTION 4. i'hat the entire cost of construction of said sidew&lks shall be legied on a11_the lande abutting on the westerly sicle of S.O.M: Center Road, and abutting saiii sidewalk between Wiloon Mills Road and the north line of thE propesty of the Board of Education. SECTION 5. That the assesam!nts for said improvement shall be, certified to the County Auditor 3n tne manner pronided for by law Por all a,ssessments and shall be.collected by the Treasurer of CVahqga County in the usual manner of colleeting tages and aesessments.
