x Ordinance No. 199 By Mr. Beard AN ORDINANCE TO AMEND CONTRACT OF THE vILLl~.GE OF T~IAYFIELD, OHIO, WITH THE CLEVELAND ELECTRIC ILLI7MINATING COMPANY RELATING TO STREET LIGHTING SERVICE AND TO RATIFY AND CONFIRM THE EXISTING CONTP~-1CT IN ALL OTHER RESPECTS, WTTEREAS, 'the Municipality entered into a contract for street lighting service with The Cleveland Electric Illuminating Company authorized by Ordinance Noy 381 passed August 20, 1951 WHEREASA in order to avoid the e_tpense which would be involved in cancellation and proceclures for entering into a new contracts The Illuminating Company has proposed that in lieu of such cancellation the existing contract be amended and continued in effect for the remainder of the contract term, L~ and such amendment would be in the best interests of the V%~~(f~f ~~~~/~ NOW s T'fiEREFORE s~- .- . -- BE IT ORDAINED by, the. Ohios SECTIbIv I m That this Ordinance:is hereby declared to be an emergency ordinance in that it is necessary t.o pr..ovide for the public'~..peace; 'Health: arid. ,.safety>by supplying electric lighting service and, ,pertains to the. usual and, daily opera- tion of a municipal ~depar-tmenta SECTION II. That said contract authorized by Ordinance No. 381 be and the same i~s hereby amended to provide that beginning January 19 1956a and for the remainder of the contract term thereafter, the provision for discounting monthly bills at tTie rate of 6f shall be eliminated and so that beginning on said January 1, 1956, all bills by said Company to the ViL-age of Mayfield , Ohio for such service shall be subject to a discount of 3% of the gross amount so billed;, if the net amount is paid in full within 60 days from the billing date Any billings for rep7~.cements under Section 2 or for discontinuances of lames under Section 3 of the contract; are net and shall not be subject to discount, and the said contract entered into pursuant to said Ordinance passed August 20, 1951 be and the same is hereby ratified3 confirmed and. continued in effect for the remainder of the contract term in all other respects excepting only as herein expressly modified:.
