Th.at the assessmen-b of the cost and expense of improvin.g <br />SOM Center Road in the Village of liayfield, Ohio, from Highland Road in a <br />Southerly directa.on 2650 feet to the existing water main, by the construction <br />of a taater main and appurtenances therein, amounting in the aggregate to <br />$27,404.61, as reported to -this Council on the 15th day of June, 1959, and <br />as reported to the Clerk on the 27-Gh day of May, 1959, by the Board heretofore <br />appointed to estimate said assessments9 notice oi the Filing of which <br />assessments has been given as required by 1aw, be and the same is herebJ <br />adop-ted and confirmed, and that the-re be and 'uhere is hereby levied and <br />assessed upon the lots and lands bounding and abutting upon both sides of <br />SONI Cen-ter Road' from High7.and Road in a Southerly direction 2650 feet to <br />the exis-ting Urater main, ( except that the premises situated oiz the <br />Southtrest corner of SOM Center Road -and Highland Road, otmed by W. A. & N. E. <br />Probeclc9 and knozm as Auditorts Permanent No. 831 L-13, shall be ]exempt <br />from said assessmen-t to the el.tent of the 3vortherly 100 feet of frontage <br />on SOM Center Road.9 for the reason tha-t said parcel oi property has already <br />heen assessed for a sim-i.lar water main improvement "construct,ed in Hijhl.and <br />Roacl, and it would be inequitable to assess the Idortherly 100 f eet of <br />frontage on SONI Center Road for the SOET Center Road improvement) the <br />several an.ounts reported as aforssaid, tihich assessments3 together wi-th <br />the descriptions of said lots and lands, are nata on fi1e in the oifice <br />o:F the Clerk of 1;his Council9 and which assessments are in proportion to <br />the special benefi-ts and are not in excess of the special benefits to said <br />property' and are not in excess oi ar?y statutory limitation. <br />Sec. 2. That the total assessment against eacli said ,ot or parcel of <br />land shal.l be payable in cash within 30 days from and after the passage of <br />this Ordinance' or at the ontion of the otaner, in t,en annual i.nstallments9 <br />with interest at the same ra-te as shall be borne on the bonds to be issusd <br />in anticipation of the collection of the same.
