Belzer <br />AN ORDINANCE TO AMEND ORDINANCE No, 159, THE ZONING <br />ORDINANCE OF THE VILLAGE.OF HAYFIELD, BY ADDING SECTION <br />19,,1 PERTAINING TO_FENCES IN RESIDENTIAL DISTRICTS <br />Tr7HERE.AS, adequate provisions are not made in the present zoning <br />ordinance to govern the height and type of fences in residential districts, <br />and it is necessary to do so in order that owners of property in such <br />districts will not be deprived of necessary light and air and in order <br />that their property will not be depreciated in. value by reason of the <br />presence of unsightly and unsafe fences on adjacent property; and <br />WHEREAS, Council finds that this amending ordinance has been sub- <br />mitted to. the Village Planning and Zoning Commission for approval, disapproval, <br />or suggestions, and that said Commission has allowed a reasonable time for <br />consideration and reports and has approved the same in the form herein set <br />forth, and that a public hearing has been had thereon, and notice of such <br />hearing given in the manner provided by law.. <br />NOW THEREFORE BE TT ORDAINED BY THE COUNCIL OF THE VIZLAGE OF <br />HAYFIELD, COUNTY OF CUYAHOGA AND_STATE OF_OHIO, THAT:_ <br />Sec. 1. ORdinance No, 159, the Zoning Ordinance of the Village of <br />Hayfields is hereby amended by adding thereto Section 19.1,. which shall <br />read as sollows: <br />"Sec. 19,1. Fences in Residential Districts. <br />(a) In Front Yards, In front yards in Class U~-1, U-2, U-3, and <br />U-3 AA. Use Districts, the only fences permitted shall be open ornamental <br />fences, which shall be placed adjacent to the front entrance of the <br />dwelling, and not over 42 inches in height. An ornamental split rail <br />fence may be placed at a point not closer than 12 inches f"rom the <br />front property line, <br />(b) In Side and Rear Yards. In side yards and rear yards in <br />Class U-Z, U-~2, U-3 and U-3 AA use districts, the only fences permitted <br />shall be as follows: <br />Open fences not over 4-1f2 feet in height shall be permitted <br />along the side line of rear yards and along the rear lot line, provided <br />such fences shall have uniformly spaced openings aggregating 25% of <br />their surface areas between residential propertiesq Provided, however, <br />that an open or a closed fence not over eight feet in_height may be <br />placed along the rear or side line which separates residential property <br />from property used for non-residential purposes, subject to the written approval <br />. of the adjacent property owner and the approval of the Building Inspector, <br />who shall not give his approval if he finds that such proposed fence is <br />unsafe or unsightly or that it obstructs necessary light and air from adjacent <br />
