ORDINANCE No. 804 By Mr. Belzer AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF SOM CENTER_ROAD_IN THE VII~IAGE OF HAYFIELD., OHIO, FROM THE_ END OF THE EXISTING.WATER_MAIN WHICH TERMINATES 1528 FEET NORTH__OF.THE CENTER DINE OF METRO.PARK DRIVE, IN A NORTHERLY DIR.ECTION,TO THE, NORTH CORPORATION LINE_OF THE_VILLAGE.OF . HAYFIELD, BY THE CONSTRUCTION OF A WATER MAIN AND_APPUR-_ TENANCES, AND., DECLARING AN EMERGENCY. _ BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, COUNTY OF CUYAHOGA AND..STATE OF OHIOs,. _. Sec. 1. It is hereby determined to proceed with the improvement of SOM Center Road in the Village of Mayfield, Ohio, from the end of the existing water main which terminates 1,528 feet North of the center line of Metro Park Drive, in a Northerly direction to the North Corporation Line of the Village of Mayf field, by the construction of a 16" cast iron water main, with curb connections and appurtenances. Sec. 2. Said improvement shall be made in accordance with the provisions of Resolution No. 559, adopted on April 15, 1963, and with the plans, spec if ications, estimates and prof Iles heretof ore approved and now on file in the off ice of the Clerk of this Village for the improvement of SOM Center Road within the limits above described by the construction of a 16" cast iron water main, with curb connections and appurtenances. Sec. 3. All claims for damages resulting therefrom that have been legally filed shall be inquired into bef ore the commencement of the proposed improvement, and the Solicitor is hereby authorized and directed to institute legal proceedings in a court of competent jurisdiction to enquire into claims that have been so filed. Sec. 4. The portion of the cost provided in the above mentioned resolution of_necessity to be assessed shall be assessed in the manner and the number of installments provided in said resolution and on the lots and lands described therein. Sec. 5. The estimated assessments heretof ore prepared and filed in the off ice of the Clerk of this Council are hereby approved and adopted. Sec. 6. The Clerk of this Council is hereby directed to deliver a certif ied copy of this ordinance to the County Auditor within 15 days after its adoption.
