ORDINANCE Noa 841 <br />By Mr. Belzer <br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE <br />VILLAGE OF ~AYFIELD,_BY TRANSFERRING-CERTAIN_PROPERTY <br />IIV-. THE NORTHG.TEST PORTION. INTO _ CLASS U--3 ,AND U~4 _ <br />USE•DISTRICTS- -. .. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF NIAYFIELD, CUYAHOGA COUNTY <br />OHIQ, MEMBERS THEREOF CONCURRING THAT: •.., <br />FhIEREAS, Council finds a large area of land in the Northwesterly <br />portion of the Village hereinaf ter described, lying generally between <br />Wilson Mil.1s Road and the sublots abutting-Highland Road and between the <br />Freeway and SOM Center Road, now zoned variously as Motorist Service <br />Districts, Off ice-.Laboratory Districts., and production-Distribution Districts, <br />and in part for single residence uses, has never been used for such purposes <br />and cannot feasibly and prof itably be used as such because of the lack of <br />utilities and highways in the vicinity of said property and the high cost of <br />development thereof and the lack of demand for such property for the uses <br />for which the same is now zoned; and <br />WHEREAS, the owner of more than 50% of the property hereinaf ter <br />described- has- filed a Petition with Council under~Section 23 of Ordinance <br />No. 159, the Zoning Ordinance of said Village, requesting the amendment to <br />the Zoning Ordinance hereinaf ter set forth; and <br />WHEREAS, Council finds that the use of said property for commercial <br />purposes. and for multi®f amity purposes will be conducive to the public <br />health, peace, safety, comfort, prosperity, convenience and general welf are, <br />will provide more prof itable and benef icial uses for the owners of the land, <br />will provides' added and needed tax revenues for the Village, enabling it to <br />carry on needed functions, and will not substantially injure any other property <br />in the Village or the use thereof; and <br />WHEREAS, this amending ordinance has been submitted to the Village <br />Planning & Zoning Commission for approval, disapproval, or suggestions and <br />said Commission has been allowed a reasonable time for consideration and <br />report and has made its report thereon, and that a public hearing has been <br />had thereon, with notice of such hearing given in the manner provided by law.. <br />NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VIZ,LAGE OF MAYFIELDs <br />COUNTY OF CUY,AHOGA AND STATE OF,OHIO., MEMBERS THEREOF.CONCURRING THATo. <br />-~~r <br />
