Sec. 1. Council hereby authorizes Leslie Belzer to have constructed an 8 inch water main with appurtenances in Beech Hill Road in the Village of Mayfield, starting at the end of the existing water main, which is about 225 feet north of Seneca Road, and extending in a northerly direction about 408 feet. Said water main is to be constructed for said Leslie Belzer by Montagna Construction Co. according to the rules and regulations_of the water department of the City of Cleveland, Ohio, in accordance with the plans, profiles and specif ications approved by H.P. Peterson, the Village Engineer, and subject to the approval of the Building Inspector of -the Village of Hayfield, or any Inspector especially appointed f or_that purpose by the Council. The constr~.ction of said water main and appurtenances is to be done in accordance with the terms of the contract between 7~eslie Belzer and Montagna Construction Co. In connection with said contract,_there is to be deposited with the Village.of Mayfield a policy (or a copy or certif icate thereof) of liability insurance, insuring against bodily injury liability in the amount of One Hundred Thousand Dollars ($100,000.00) for each person and Three Hundred Thousand Dollars ($300,000.00)-f or each accident, and property dotage: liability in the _amount of Fifty Thousand Dollars ($50, 000.00) in connection with the work to be done. under said constructio~t contract. The said contract shall also be accompanied by a cash perf ormance bond or surety perf ormance bond in the amount of Four Thousand Dollars ($4,000.00), in form to be approved by the Village Solicitor, guaranteeing perf ormance of said contract and payment of all claims for material and labor furnished in cotinectbon therewith. In the event that Montagna Construction Co. does not complete performance of.the~contract, the said Zeslie Belzer shall complete the same, and if both fail to complete the performance, of the contract, the Village of Mayf field shall have the right to complete construction and to look to I+eslie Belzer, Montagna Construction Co. and the company executing the surety bond-for reimbursement theref or. _ Sec. 2. Said construction work shall be supervised by H.P. Peterson Company. Said Leslie Belzer shall pay all engineering costs. in connection with the installation of said water main. Sec. 3. No person, firm, or corporation shall be issued a permit or be permitted to make a water connection to the above described water main within ten years after the date of this ordinance, unless such person, firm or cor- poration making such. connection first pays to Leslie Belzer, or his heirs,
