Carmen <br />T A RESOLUTION AUTHORIZ ING THE MUNICI- <br />PALITY TO PLOW THE SIDEWALKS ON BETA <br />DRIVE AND TO CHARGE EACH ABUTTING <br />PROPERTY OWNER/TENANT A SUM OF ONE <br />HUNDRED EIGHTY DOLLARS ($180.00) PER <br />WINTER SEASON FOR SUCH -SERVICE, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Municipality requires that the tenants of the <br />Industrial Park on Beta.Drive maintain the sidewalk abutting Beta <br />Drive located on their respective properties, including the removal of <br />snow during the winter season; and <br />WHEREAS, many of the tenants in the Industrial Park do not <br />have the necessary equipment to keep their sidewalks free of snow and <br />have requested that the Municipality perf orm that service; and <br />WHEREAS, upon the recommendation of Building Commissioner <br />Gus Amendola the.Mayor and Council have determined that said service <br />can be performed for the sum of One Hundred Eighty Dollars ($180.00) <br />per Winter season per parcel in the Industrial Park; and <br />WHEREAS, the Mayor and Council further feel that it is <br />necessary for the health, safety and welfare of pedestrians on Beta <br />Drive to maintain the sidewalks free and clear of snow; now, <br />therefore, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br /> <br />Section 1. The Mayor and Council of Mayfield Village, <br />Ohio, do hereby authorize the Service Department of the Municipality <br />to plow the sidewalks on Beta Drive provided that the municipality <br />receives the sum of One Hunc3red Eighty Dollars ($180.00) per parcel <br />per Winter season for such service. <br />Sec ion 2. That the Council finds and determines that all <br />formal actions of this.Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory reguirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 3. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents' of Mayfield Village for <br />the reasons set forth in pr'eamble hereto. It shall theref ore take <br />effect immediately upon passage by the affirmative vote of not less <br />than four (4) members_elected to Council and approval by the Mayor or
